3. SELLER’S REPRESENTATIONS: The following representations, conditions apply to the sale of the described dog. The dog in good health, free of communicable diseases. Once the Buyer takes possession of puppy, they have 72 hour for veterinarian examination. By taking possession, Buyer is completely satisfied, waiving any claims regarding dog’s conformation, and outward appearance.
4. CONSIDERATION: Dog as identified in Sec.1, sold for the sum of $_________ as described in Sec.1. Non-refundable Deposit. If buyer needs to sell or place puppy, Buyer will notify Seller of new owner. Buyer agrees to pay the veterinarian fee of $78, for puppy leaving prior to 8 weeks.
5. LIMITATIONS OF CONTRACT: This contract applies to the original puppy only and is non transferable. Buyer is responsible for transportation costs to/from Diamond Oaks Ranch.
6. HIP GUARANTEE: The breeder will only guarantee genetic hip dysplasia. Genetic hip dysplasia will show up in the puppy before 1 year of age. Later development of hip dysplasia is not guaranteed, as this is often environmentally produced. The puppy’s hips must be x-rayed before 1 year of age by a veterinarian certified and skilled at producing hip x-rays for OFA evaluation. These x-rays must be submitted to OFA for evaluation the puppy is guaranteed by the breeder to certify in preliminary OFA x-rays as being Excellent, Good, or Fair. If the puppy is not rated Excellent, Good or Fair, and therefore is dysplastic, the buyer can choose from the following options: a. Return puppy, receive replacement puppy from the next available litter. b. Keep puppy, get 1/2 of purchase price refunded. Proof of spay/neuter required. c. Return the puppy for a 100% refund.
7. MAINTENANCE: Buyer agrees to maintain this dog in good health, provide routine preventative health care including, inoculation, internal and external parasites. Buyer further agrees to provide proper exercise to maintain this dog in proper weight and physical condition. A proper diet consists of good-quality dog food and supplements. Buyer agrees that this dog is NOT to be just in a cage or kennel only. This dog sold with the understanding that it was to go to a selected family, Buyer promises the dog would become a family member. Buyer understands that the Seller will repossess dog upon evidence of neglect/abuse at no expense to Seller. If for any reason the Buyer cannot keep dog, they will return it to Seller.
8. OTHER: Buyer agrees to provide Seller with photos and copies of awards, critiques along with the judge(s) name(s), the Club sponsoring the show or competition for advertising.
Buyer agrees that he/she understands this contract fully, and that this contract took place in the venue and under the jurisdiction of the State of California, in the county of Riverside.
