Puppy Diseases Guarantee
We guarantee the health of this puppy for the first 48 hours after leaving our care. Our guarantee is limited to the following diseases: Parvo virus, Canine distemper, Adenovirus and Influenza. Puppy should be checked by buyer's vet within 48 hours of purchase. If written notice by your vet within 48 hours of leaving our care, shows this puppy to have any of the above diseases and our vet confirms this, we will replace this puppy with another puppy of the same sex and value of breeder's choice as soon as one becomes available. Absolutely no cash refunds-replacements only!
*If it is found that the puppy has any of the above diseases and buyer elects to keep the puppy and treat it, at no time will the seller be responsible for any veterinarian fees.
Genetic and Hereditary Diseases Guarantee:
1. The Buyer must have the puppy examined by a licensed veterinarian within two (2) business days of receipt of the puppy. The Seller must be informed immediately of the examinations result by e-mail or fax. Failure to comply will render this guarantee void.
2. The Buyer is responsible for the daily health care and maintenance of the pet, including all immunizations and examinations recommended after purchase, as well as providing necessary medication and follow-up treatments from veterinarian visits. In order for the guarantee to remain in effect you must keep receipts and records to verify that you have regularly taken your pet to a duly licensed veterinarian for checkups and all required immunizations.
3. In the unlikely event of the death of the puppy within one (1) year from its birth due to genetics, the Seller shall replace the pet with another of equivalent value at no cost to the Buyer as soon as one becomes available with the following conditions to apply:
a. Seller must be notified within 24 hours of the death of the puppy.
b. A death certificate and autopsy report detailing the cause of death, along with any associated paperwork must be submitted to the seller before a puppy replacement will be given.
c. The seller reserves the right to have the puppy examined by by a veterianrian of their choice before a replacement puppy is given.
4. In the event of the death of the puppy, due to genetics, after the first year of birth, the Seller shall issue a credit in the amount of 45% of the original cost towards the purchase of a replacement puppy of equivalent value to the buyer within 120 days. All conditions listed above in clauses a. through c. will apply.
5. If the Buyer declines the replacement puppy, then the Seller shall be under no further obligation and it will be deemed that the Buyer has released the Seller from all further claims.
6. The value of the puppy for the purpose of this guarantee is solely the original purchase price of the puppy, and does not include shipping costs, health certificate, shipping crate or any additional prices declared by the Buyer.
7. This guarantee is non-transferable. In the event this guarantee is exercised, the registration papers must be returned to the Seller.
8. All puppies are sold as pets; no guarantee is made as to disposition, conformation, size, weight, color, markings or breeding ability.
9. This puppy will be registered with AKC under a limited registration.
10. This puppy shall be spayed/neuetred by 12 months of age, and a certified veterinatian proof of surgery should be send to the breeder as soon as the dog is spayed/neutered.
11. Seller will send the AKC registration papers to the buyer ONLY after proof of sterilaztion of the dog is recevied from the buyer. Seller will send the buyer the above paperwork within 30 days.
Fees:
1. Registration papers for all registered puppies will be sent by regular mail which could take up to 60 days. If the papers are lost, the Seller will assist the Buyer in obtaining new papers at the Buyers expense.
2. In the event of any litigation in connection with this contract, the Seller will be paid reasonable attorney fees by the purchaser. Venue and jurisdiction for litigation arising out of or related to this contract shall lie exclusively in Los Angeles County, California.
Returns:
1. The seller will not accept any returns of said puppy for any monetary refund, including but not limited to allergy, Landlord/Tenant, marital, or adjustment problems, etc. If Buyer must return puppy for any reason, it will be on a surrender basis only with no refund or store credit.
Shipping (Via Airline) agreement
1. Seller shall not be responsible for loss/ death of puppy while in transit via airplane. Seller is responsible for this puppy's well being UP UNTILL the point it is given to the airline attendant for shipping at the airport.
2. Buyer is stongly advised to purchase travel insurance for this puppy prior to shipping it.
3.In the event that the said puppy is lost/dies, buyer shall seek seek monetary compensation from the airline company only. No refund will be given to buyer by seller is such event.
4. Buyer is aware and agrees to pay additional costs that will accur in the shipping of this puppy. some are: Veterinarian health certificate ($67), shipping crate ($35).
5. Usually the puppy will ship within 5 - 7 business days, but occasionally a puppy may need additional time with the breeder before shipping. The final determination of the shipping date for the puppy is made by the breeder and the breeder's veterinarian, with the health of the puppy being the overriding factor.
Handling of shipping charges:
1.A $60.00 shipping handling fee will apply when shipping the puppy from Burbank airport (160 miles round trip from my residence).
2. A $100.00 shipping handling fee will appley when shipping the puppy from LAX airport (200 miles round trip from my residence).
3. Transportation of the puppy is arranged through third-party carriers. Occasionally there may be delays for numerous reasons including, but not limited to, weather, temperature restrictions, logistics, mechanical failure, or other unforeseen events. The Seller shall not be liable directly or indirectly for any delays that may cause the Buyer inconvenience or financial loss.
* Buyer understands the shipping agreement and agrees to for for additional handling/shipping fees for said puppy if others may arise.

I, the purchaser of a puppy from Eilat Toy Pooldes, hereby acknowledge that I have received a copy of this document as well as described herein pertaining to my pet's health inspection signed by veterinarian. Further, I accept the terms and conditions of the guarantee for congenital or hereditary disorders printed in this document, and I waive and relinquish any other rights that I might otherwise have in the event of such occurrence. This agreement represents the total agreement between Eilat Toy Poodles and the buyer and no other terms or conditions shall be valid to this sale. The purchaser acknowledges that he or she has read, understands and agrees to the terms of this document. No cash or credit card refunds.
