Puppy Sales Contract
THIS PUPPY SALES CONTRACT is made and entered into this __th day of ___________ in the year 20__ between Dawn-Renée Mack, (hereinafter referred to as “Breeder”), and __________________ (hereinafter referred to as “Purchaser”, whether one or more persons).
WHEREAS, in order to protect this pet from relinquishment to a breed Rescue, animal shelter or humane society, from being sold, given or traded to anyone other than the original purchaser without prior consent from the Breeder and/or from being inappropriately euthanized; and,
WHEREAS to provide a happy, healthy, lifelong home for the pet listed below,
NOW, THEREFORE, it is agreed as follows:

1. The above puppy is being sold as “Pet Quality” for the sole purpose of companionship with no guarantee of conformation.
2. Pet is being sold on a “Limited Registration”, which means that no offspring of this pet can be registered with AKC. In keeping with her natural methods of rearing, the Breeder would prefer this pet not be neutered until he is at least 6 months old; preferably after 14 months.
3. The Breeder will not be liable for any damage or injury caused by this pet.
4. This pet is being sold primarily as a companion and family member. He is not to be an “outside” dog. Purchaser is required to care for the pet in a humane manner, providing exercise and reasonable veterinary care. If the Breeder finds that the Purchaser is not caring adequately for the pet, the Breeder reserves the right to take the pet back.
5. The Breeder requires first right of refusal, i.e., that the Purchaser agrees if that at any time they are no longer able to keep or care for the aforementioned pet, Purchaser will return the dog to the Breeder. Purchaser agrees to never place the pet in Rescue or at a shelter or to leave the pet at a veterinarian’s office. Purchaser agrees to never give the pet away or to euthanize the pet without the written permission of the Breeder. No refunds will be given.
6. The Breeder encourages the Purchaser to feed a high quality raw diet and to limit vaccinations.
7. Pet is guaranteed for a lifetime to be free of hereditary/congenital defects (e.g. epilepsy, primary glaucoma, general PRA, IVDD) that prevent it from being a quality companion. Upon acceptable diagnosis of above hereditary/congenital defect, pet will be replaced with another of like sex/value, or buyer will receive monetary reimbursement – at the Breeder’s discretion.
8. Delivery costs to unite pet with buyer or to re-unite pet with Breeder, for any reason, are at the expense of the Purchaser and are not refundable.
9. AKC papers will accompany returned pet with transfer of ownership of the pet back to the Breeder.
10. Any monetary refunds will be calculated based upon full purchase price listed in this contract, less any deposits, and less any shipping/delivery fees.
11. The Purchaser agrees to make pet available to the Breeder for purposes of eye exams, spinal films, patella checks, all at the expense of the Breeder.
12. The Purchaser agrees to keep the Breeder immediately notified to any changes to address, phone number or email address.
13. In the event that the terms of this agreement are not complied with, the Breeder is entitled to $5,000 in damages and the return of the pet (including full ownership and the AKC paperwork to prove such ownership) plus any legal fees and costs associated with the enforcement of this agreement. Any actions taken will be conducted within the state of Colorado, Jefferson County.
14. This Contract is governed by the laws of the State of Colorado, Jefferson County.
