Terms and Conditions
1. Puppy is placed for the sum of $
... Puppy is deemed to be of companion quality by breeder.
2. Said puppy is to be spayed/neutered no earlier than six months of age and no later than 14 months.
3. Buyers agree that said puppy shall not be sold, assigned or given away without prior consent of the Breeder and if said puppy can not be kept for any reason, Buyers shall return said puppy to Breeder, at no expense to Breeder.
4. Breeder warrants said puppy to be free from any major defect and/or disease. Should said puppy be diagnosed with a genetic, inheritable condition at any time prior to two years of age, that so affects said puppy that he/she cannot fulfill his/her purpose to be a pet and companion, Breeder agrees to replace said puppy with a puppy of similar quality from the first available litter or to refund 50% (fifty per cent) of the purchase price. Breeder will not be liable for any vet bills incurred by Buyers for the diagnosing and treating of any condition. This warranty specifically excludes entropian (an inherent hazard in Chinese Shar-pei), prolapse of the third eyelid (cherry eye), juvenile localized demodex, acquired allergies and amyloidosis after the age of 2 years. Buyers should also be aware that Chinese Shar-pei as a breed suffer from a fatal kidney disease (renal amyloidosis), which is believed to be genetic in origin. As of this date, no test has been developed for this disease, therefore Breeder CANNOT warrant said puppy is free of said disease. Breeder does request that when and if such a test becomes available Buyer take said puppy to be tested and forward the results to the Breeder.
5. Buyers shall have ten (10) days to have said puppy checked by a veterinarian of Buyers choice, at Buyers expense, should Buyer so desire. Should Buyers veterinarian certify said puppy to have a congenital defect or disease (excluding entropian and elongated soft palate). Buyers may return said puppy to Breeder for a full refund of the purchase price.
6. Said puppy shall be kept as an indoor dog and shall be kept in a fenced yard or on a leash and shall not be allowed to run free unsupervised.
7. Said puppy has been wormed with Nemex 2 at ......weeks of age.
8. Said puppy has received the following shots: First shot, ............ . No adverse reactions were observed in the puppy after the administration of any of the shots. Buyer should note that latest vaccination protocols suggest vaccination every three years as opposed to every year.
9. Killed parvo is perferred but if killed is unavailable then live is acceptable as long as the vaccination is given separately and NOT as part of a combination shot. At no time is said puppy to receive vaccinations for corona, lepto or bordetella (kennel cough) prior to six months of age and only if absolutely essential. Buyers agree to follow the vaccination schedule and protocol, to the best of their ability, as outlined by Breeder and to NOT allow any veterinarian to perform any procedure such as mitaban dipping or entropian surgery, without prior advice from Breeder.
10. Said puppy is to be fed a premium quality food without soy. At no time during said puppys life should he/she be fed a food with more than 23 or 24% protein.
11. Said puppy will be taken to basic obedience so said puppy will become a well-mannered, acceptable companion and Buyer agrees to achieve a minimum of a CGC (Canine Good Citizen) on said puppy.
12. Should said puppy die unexpectedly, then Buyers agreed to inform Breeder within 24 hours of such an event. Buyers further agree to have a qualified veterinarian perform a necropsy. Breeder agrees to pay fifty per cent (50%) of the cost of the necropsy and all results are to be forwarded to Breeder. Should said puppy die of old age then the above condition is null and void, however in such case that a test for amyloidosis has not be developed, Breeder requests that Buyers obtain kidney and liver biopsies on said puppy and furnish Breeder with the results.
13. Buyers agree to inform Breeder of any change of address throughout the life of the puppy.
14. Buyers expressly understand that should any clauses in this Contract be breached, Buyer shall be liable for $3,500 unconditionally, per each paragraph of the Contract that has been breached. Any litigation concerning this Contract shall take place in Orange County, New York.
15. It is also understood that if it becomes necessary for Breeder to retain an attorney due to Buyers breach of Contract, Buyers shall be liable for all attorney and court costs.
16. If this contract is not being adhered to, or if Breeder discovers that buyer is not taking care of said puppy, if said puppy is not being kept as a house dog or if said puppy is being abused/mistreated, Breeder has the absolute right to take said puppy back, with no refund to Buyers and Buyers will be liable for all court costs, attorneys fees and damages.
WE HAVE READ AND FULLY UNDERSTAND ALL THE ABOVE TERMS OF THIS CONTRACT AND AGREE TO ABIDE BY ALL THE TERMS AND CONDITIONS STATED THEREIN, TO THE BEST OF OUR ABILITY.
WE HAVE ALSO READ AND UNDERSTOOD THE CARE OF YOUR PUPPY SHEET AND AGREE TO FOLLOW THESE INSTRUCTIONS, TO THE BEST OF OUR ABILITY.
