I, , hereinafter referred to as Buyer, (address) , (phone #) , have purchased a pet quality (meaning it should never be allowed to reproduce), smooth Dachshund described as follows:

from Sandra J. Russell (Breeder/Seller), hereinafter referred to as Seller), (address) 14819 Shady Grove Lane, Norwood, LA 70761, (phone #) 225-629-5067, (email) MRUSSEL1@ix.netcom.com, on _, for the paid-in-full sum of $_______, and do hereby agree to the following guarantees, warranties, and/or conditions as the terms of this sale. No other guarantees, warranties, and/or conditions are either expressed or implied.
1. Seller guarantees that the above described dog is a purebred Dachshund either already registered with the American Kennel Club (AKC), or is eligible for registration with the AKC within one year of its date of birth. A "Limited" registration application will be signed over the Buyer upon receipt of written confirmation from the Buyer's licensed veterinarian that the above described dog has been neutered (spayed or castrated) and rendered incapable of reproducing. A "Limited" registration means that the progeny of the above described dog shall never be eligible for AKC registration as purebred, and theat the above described dog can never be shown in AKC conformation shows. It will be eligible, however, for entry into all AKC performance
2. Buyer shall receive from the Seller a true copy of the above described dog's pedigree on the date of sale or shall be able to access the pedigree online on the Seller's web site.
3. Seller guarantees the above described dog to be in good health at the time of sale (no known congenital/genetic defects or conditions, and no known communicable diseases), and furnishes the Buyer with a complete health record of the dog on date of sale. Buyer shall have 5 working days from the date of sale in which to have the dog examined by a licensed veterinarian. If the veterinarian finds the dog to be suffering from a serious health defect (other than a communicable disease) substantially affecting the future use of the dog as a companion, Buyer may return the dog to the Seller (Buyer and Seller to share equally in shipping costs, if applicable, to return dog to Seller) within 72 hours of the examination together with the certificate of the examining veterinarian. Seller will then refund to the Buyer the full amount of the purchase price. If the dog has a communicable disease, it must be returned to full health (Seller to pay pertinent veterinarian fees) before being returned to the Seller for a full refund. Buyer shall assume full responsibility for the health, anatomical makeup, appearance, and temperament of the above described dog following the first 5 working-day period.
4. Should the above described dog be diagnosed after the first 5-day period from the date of sale as having a genetic defect(s) and/or genetically induced illness(es) impairing its ability to function as a companion (not including show faults as defined by the AKC and The Dachshund Club of America in " The Official AKC Standard of the Dachshund " (dated 3/07), nor fertility or reproductive defects [such as undescended testicles]), the Seller will provide another dog of the same sex and color of comparable value at the earliest possible date, under the following conditions:
a) Buyer shall furnish certification from a licensed veterinarian that the dog has been euthanized due to this genetic condition;
b) Seller must first be notified that such action is being considered, or no replacement will be made; and
c) Seller reserves the right to have the animal re-examined by a licensed veterinarian of the Seller's choosing before any replacement is made for genetic defects.

Should the Buyer decide to keep the dog despite the genetic defect(s) and/or genetic illness(es) seriously affecting its use as a companion, the Seller shall refund $50.00 to the Buyer to help defray medical expenses. Seller shall then be under no further legal obligation to replace this dog at a later date for any reason(s).
7. Buyer agrees that, if at any time in the future, he/she does not want to keep and maintain the above described dog, Seller has first refusal rights on the repurchase of said dog for a total amount of $100 or the original purchase price, whichever is less (Seller to pay shipping expenses, if any). 8. Failure of the Buyer to comply with all of the terms and conditions of this sales contract shall result in legal action by the Seller against the Buyer. In the event the Seller must seek legal means to enforce said contract, the Buyer agrees to bear full responsibility for the legal fees of both parties, which shall include but not be limited to: all filing and paperwork fees, attorney's fees, court fees, time lost fees, and/or any other fees that may be applicable
under the law and not put forth herein, as well as any and all judgements brought to bear against the Buyer(s) by a court of law.
The above named Buyer and Seller have executed the foregoing contract of sale on this day of , at Norwood, State of Louisiana. By signing below, Buyer(s) indicates that he/she/they understands that the above contract is LEGAL AND BINDING.
