SPAY/NEUTER PROSPECT:
I. Spay/Neuter Ownership price of $________, has been agreed upon between the Seller and the Buyer. The seller agrees to sell and the buyer agrees to purchase the puppy/dog described above as a Spay/Neuter puppy from the litter described, subject to the following terms.
II. The Seller, __Kristina Brem__, has made it aware to the Buyer that the selected puppy is being sold on a SPAY/NEUTER Contract. The Buyer is responsible for spaying or neutering the said puppy between 4 to 12 months of age. Copies of the alteration must be provided by the Buyer to the Seller, within 2 weeks post-surgery.
a. If the said puppy is to be bred during this contract (accidental or not), Seller has full rights to pursue legal action if necessary, in reclaiming the puppy. Should a breeding happen, the Buyer must notify the Seller and must relinquish ownership of said puppy and papers. No refunds shall be given, as the contract has been voided by the Buyer. Buyer must forfeit puppy immediately and will not be eligible to purchase another puppy from the Seller.
III. Ownership of the puppy/dog will be transferred to the Buyer for the sale price of $______, with selected puppy to be paid as follows: $___200___ non-refundable deposit on execution of the Agreement, with the balance of $_______, plus shipping fees of _______, to be paid on or before the puppy/dog leaves the Sellers premises. If the balance is not paid by __PAID IN FULL__, (no later than 12 weeks of age), this Agreement shall be cancelled and the Buyer forfeits the deposit given hereunder. Contract will be fulfilled when Buyer has paid in full and selected Puppy will be released to new owner upon 8-9 weeks of age.
IV. Seller warrants that the above described puppy/dog is a purebred Australian Shepherd registerable with AKC and/or ASCA registration papers that have _____, or have not_____, been provided to the Buyer as of the date of the completed purchase, together with a true copy of its pedigree.
V. Seller warrants that the above-described puppy/dog is in good physical and mental health at the time Buyer assumes ownership. Buyer agrees to have the puppy examined by a licensed Veterinarian within Three (3) business days (not including weekends and holidays) of receipt of puppy/dog. If, as a result of the examination, the Veterinarian determines that the puppy/dog is not in good health, then the Buyer may do the following options:
a. The Buyer shall elect to keep the puppy/dog and assume all cost for its care
b. Or, The Buyer may return the puppy/dog to the Seller for a replacement puppy/dog or refund. If the buyer elects to return the puppy, Buyer shall, within 10 days after receiving the puppy, send to Seller by certified mail a written Veterinarian's certificate stating that the puppy/dog was in ill health when examined. Upon receipt by Seller of said certificate, Buyer shall be obligated to return the puppy/dog to Seller. Upon receipt of the puppy/dog, the Seller shall be obligated to refund all monies received from Buyer toward the purchase price of the puppy/dog, and further performance under this contract shall be null and void.
VI. The Seller is not responsible for loss of puppy due to death, theft, sickness, or other loss once the puppy had been placed with the buyer.
VII. Puppy/dog is required to carry the _____Brem Ranch___ kennel name.
VIII. If at any time the buyer can no longer retain possession of this dog, the seller is to be notified and given FIRST OPTION of resuming full ownership at a price to be mutually agreed upon by both parties. This would take into consideration the costs incurred by the Seller in caring for the dog and locating a new home. The dog will be returned with the AKC/ASCA papers and all medical records.

IX. BUYER RESPONSIBILITY:
a. HEALTH CARE AND VACCINES: The Buyer must take full responsibility for said puppy’s care which includes yearly vaccines, flea, and heartworm prevention. All vaccination records must be available for Breeder’s inspection, preferably with the Veterinary Clinics provided by the Buyer below. The puppy must also have all regular boosters and immunizations (appropriate to your lifestyle and regional area). In the event of accident or injury, the Seller would like to be informed of the said puppy. Any necessary veterinary or hospital charges are the responsibility of the Buyer, in the event of an injury or accident.
b. REGISTRATION: The Buyer is responsible for registering the puppy with AKC and/or ASCA before 12months of age. Buyer is responsible for registration and fees.
c. ENVIRONMENT: Buyer agrees to care for the puppy/dog in a responsible manner to include that the puppy will reside at the home of the Buyer, have access to a fenced yard, to include protection from traffic, not be chained or tethered, and will be provided with proper housing, nutrition, veterinary care and exercise. Buyer is expected to properly socialize and expose the puppy/dog to various situations so as to develop a sound temperament. Buyer also agrees that this puppy/dog will not be used as a guard dog or fighting dog, for any business.
d. RELOCATING: Should the Buyer decide to relocate, The Seller respectfully asks for an update of address for future circumstances.

X. HEALTH GUARANTEE:
a. Seller warrantees that the puppy/dog sold hereunder against any eye, hip or other hereditary defects that would disqualify the dog from showing or breeding for 24 months unless otherwise noted. In the event that faults are discovered within the 24-month period, and the warrantee is activated, the buyer has the responsibility to produce in writing a statement from a licensed veterinarian to that effect. The seller reserves the right to have a second veterinarian of choice evaluate the dog’s condition before the warrantee will be honored, except in the case of Orthopedic Foundation of America evaluated hip X-rays.
b. Should said purchased puppy develop any disqualifying faults as defined in the Standard (other than size), or be diagnosed with any genetically derived medical disorder which is confirmed by two unassociated veterinarians, thereby the Seller will, upon provision of veterinary reports, and where applicable Orthopedic Foundation for Animals (OFA) report, or Canine Eye Registration Foundation (CERF) certification provide Buyer with one of the following options:
A) Buyer could choose to keep Puppy, no refund is in order, with veterinarian bills the buyer's responsibility.
B) Buyer could choose to relinquish ownership of Puppy to Seller. Seller will refund purchase less any shipping or miscellaneous charges necessary for transportation of Puppy to Seller. Veterinary bills are the buyer's responsibility.
C) Buyer could choose to relinquish Puppy and accept a replacement puppy when one is available to Seller. Shipping or miscellaneous charges associated with transport of replacement puppy are the buyer's responsibility along with any veterinarian bills.
c. Seller shall not be held responsible for the development of disqualifying faults, diseases, or disorders which are due to Buyer's negligence.
d. Health Results from both Sire and Bitch will be provided at the time of pick up to the buyers. Should the health tests be lost, Seller agrees to provide another copy.

REFERRING VETERINARY CLINIC:
I. Buyer shall provide primary Veterinary Clinic and/or a Secondary Veterinary Clinic. Seller will have the right to contact one/both veterinary clinic(s). Buyer is responsible for keeping the puppy up to date on vaccines, along with flea and heartworm prevention. Seller respectfully asks to be able to follow up on the spay/neuter and or care of the selected puppy at any given time, making sure the contract is not void.
