This is a generic sample of a show contract.
POSSESSION: TBD Puppy shall be registered with the American Kennel Club in the name of Buyer The Buyer is to retain full possession rights and assume full responsibilities and liabilities for TBD Puppy, unless TBD Puppy is in the sole possession of the Breeder. Neither party to this contract may sell or, in any other way, transfer ownership or possession of TBD Puppy without written consent of the other parties. Each party to this contract agree to defend and hold harmless the other parties in the event of any lawsuit brought because of the actions of TBD Puppy while in the sole possession of that party. Buyer will offer the Breeder the right of first refusal in any change of ownership throughout the life of TBD Puppy. The Buyer is to keep the Breeder apprised of the Buyer’ current address/phone number, any change must be reported in writing within 30 days of said change.
CARE AND CONDITION: The Buyer has the sole responsibility for properly caring for and feeding a developing and functioning Show Quality Standard Longhair Dachshund. To the best of his/her ability, the Buyer will provide a safe and healthy environment. He/She will never knowingly, nor through neglect, place TBD Puppy in harm's way. The Buyer will also, to the best of his/her ability, keep TBD Puppy in proper health and condition for show ring competition. The Buyer will provide the care of a qualified veterinarian in the case of illness or injury, and for preventative health care.
BREEDING: Unless agreed upon by both parties, TBD Puppy will not be bred until she has achieved an AKC Championship title. All owners will certify TBD Puppy to be free from any inheritable diseases and will require any dog used as a stud dog with her to be so certified. Breeder will be given second pick (either sex) of any one litter whelped. Breeder will take possession of and ownership rights to the puppy they choose when the puppy is no more than 16 weeks of age. (optional for reduced purchase price)
SHOWING: Buyer will make a reasonable effort to complete the AKC Confirmation Championship of TBD Puppy. Reasonable effort includes: showing TBD puppy at least 24 times though-out a 12-month period starting no later than the 12 month birthday of TBD puppy, and continuing each year thereafter until a Championship is achieved.
WARRANTEE: Breeder shall fully warrantee TBD Puppy against any structural or physiological abnormalities or unsoundness, which can be, beyond a reasonable doubt, attributable to an inheritable factor. Breeder warrantees TBD Puppy will develop to a sufficient quality to finish her AKC Championship and be of breeding caliber. If TBD Puppy cannot meet the minimum quality criteria as outlined in this warrantee, upon documented evidence from a source deemed by the Breeder to be competent, the Breeder will either replace TBD Puppy with ownership in another puppy of equal quality and value, or refund 50% of the purchase price. If the ownership in TBD Puppy is subsequently replaced, the provisions of this agreement shall apply to any replacement.
FORFEITURE: The Buyer agrees that any willful or flagrant violation of the articles of this agreement may result, at the sole and absolute discretion of the Breeder, in the forfeiture of ownership rights of TBD Puppy, and all claims on TBD Puppy by the Buyer, without refund of monies paid.
SCOPE AND AMENDMENTS: This agreement embodies the entire agreement between the parties hereto, and supersedes any and all other agreements between the parties in connection with the syndication of TBD Puppy described herein. This agreement may be amended at any time by the consent and signature of all parties in writing, provided that the written document so states that the purpose of the document is to amend this agreement.
This agreement is hereby entered into and wholly executed in the State of California and litigation arising from any possible breach of this agreement shall be adjudicated in the State of California, under California law. All parties hereby submit themselves to the jurisdiction of said courts. Should any provision of this agreement be held invalid, illegal or unenforceable, the remaining provisions shall not be affected.
ACCEPTANCE: By signature below, the Buyer and the Breeder affirm that they have read and understand this agreement and will abide by the articles of this agreement.
