Sales Contract
This contract is executed on ______________ between Cassandra Boczar, herein called Seller and ______________________________________, herein called Buyer, residing at:___________________________________________.
The Buyer and Seller enter into and agree to the terms and conditions as set forth
by this contract. No guarantees of any type are offered or implied by this contract unless specifically stated in writing in this contract.
The Buyer agrees to buy and the Seller agrees to sell the following dog:

1) This dog is being sold as a pet of breeding quality with show potential.
Definition of Show potential- this puppy is considered by il Drago to be an excellent example of the breed. It is guaranteed to have no disqualifying faults as an adult, and to be free from hip dysplasia until the age of three (3) years. This is a puppy that we would consider keeping for our OWN breeding program. This puppy comes with full AKC registration papers, which are sent certified mail to the new owner promptly after we receive them from AKC. il Drago will rebate 50% of the purchase price of your puppy if you provide proof that this dog has achieved an AKC conformation title before the age of 3 years old. Because of the extensive guarantees that this puppy comes with, it is being sold for the sum of ________________________________ or $____________________.
2) Buyer agrees to the following payment agreement:
Deposit Agreement: If Buyer agrees to place a non-refundable deposit on above dog, the deposit will prevent Seller from selling dog, and will guarantee that the Buyer will indeed pay for the dog in full at the time of delivery unless specifically outlined below. This deposit will be deducted from the price of dog and is
absolutely non-refundable under any circumstances except if the above named dog should die before delivery.

Full price of dog plus crate and shipping fees to paid in full by the date the pups are 6 weeks old. Payments are to be made with cash, bank transfer or wire or by postal money order ONLY. The Buyer is fully aware that any and all registration papers will be held by the Seller until the above said amount is paid in full to the Seller. Registration will be mailed within 90 days of the purchase of the pup.
3) The Buyer is aware and agrees that this dog carries the “il Drago” kennel name, therefore the dogs full name will appear as it is without any other attached kennel names, on any and all registration, pedigrees, websites & advertising.
4) Seller agrees to sell dog in good health and with all shots current at the time of delivery. A full refund will be provided to Buyer within 7 calendar days from the date of delivery only if the Seller is provided with a written statement from a licensed veterinarian which clearly defines any genetic or health defects, the refund pending the return of the dog.
5) Seller does not agree to refund money or replace pup in the event the pup dies due to complications during or after an ear crop procedure. Buyer has been advised by seller of the breed specific risks associated with this surgery.
6) Seller guarantees hips & heart to be serviceable and sound if a) the dog is at least 12 months of age but not older than 36 months of age, b) has not previously been used for breeding purposes, c) the Buyer adheres to a proper diet which the Buyer has received a copy of, including but not limited to 1000 mg. of vitamin C daily, and d) the dog has not changed ownership since this sale. Buyer agrees to provide a statement from a licensed veterinarian, which clearly defines the nature of the hip or heart impairment. Copies of all veterinarian reports, x-rays, ultrasounds will be provided to il Drago within 10 days for a possible second opinion. In the event of the above conditions, Seller agrees to replace Buyer with a defect free like- kind dog from the next available litter OR refund 50% of the purchase price of the dog, whichever the Seller elects, this pending the return of the dog to the seller. No veterinary bills or fees will be paid by the Seller. No fees will be charged to the Buyer for the replacement of dog except the cost of shipping.
7) Seller is not responsible for dog should it become lost, stolen, damaged, or incur vet bills after delivery to Buyer. Buyer stipulates and agrees that the Seller
has thoroughly and understandably explained the following information concerning the dog purchased. The Neapolitan Mastiff is a large and strong breed which has been used around the world for many purposes, including guarding and protection

work of many varieties. The dog is very loyal, territorial, and capable of protective behavior on behalf of its owner. Under adverse or threatening circumstances, the dog may be aggressive, and may bite. Because of this temperament, the dog must be properly schooled and trained. Buyer hereby agrees to defend, indemnify and hold Seller harmless from any complaints, lawsuits, causes of action, or other adverse circumstances of any kind which may arise as a result of actions taken by the dog after Buyer accepts delivery of the dog referenced in this agreement.
8) Buyer agrees to take good and reasonable care of dog. This includes proper housing, feeding and both physical and emotional needs, necessary to maintain the dogs proper development. If there is documented evidence to the contrary then the seller has the right to repossess the dog.
9) Buyer agrees to return dog to seller if the dog is to be destroyed for reasons other than terminal illness or terminal injury. In the event the Buyer is unable to keep this puppy for any reason, the buyer is responsible for returning dog to Seller. Seller will only refund half of the purchase price as long as the puppy is up to date on vet care, visually in good health & has been in Buyers custody for less than 30 days. Refunds are only given once health clearances for disease and injury have been given by Sellers vet. After the 30 day period, Seller is not responsible for any refunds, but puppy MUST and is still under contract to be returned to Seller. Due to the nature of the breed and the difficult responsibility of finding proper homes for them, at no time during the life of this dog is it for “resale” to any person, pet shop, kennel or to be given away to family, friends, rescue or a shelter.
10) The seller will rebate $200 of the purchase price of this puppy if they are provided proof of spay/neuter of this dog before the age of 14 months old.
11) Seller and Buyer hereby covenant and agree that any disputes, which may arise as a result of this agreement, shall be resolved legally & timely. Seller and Buyer shall be separately and independently responsible for their own attorney fees and expenses incurred as the result of any dispute. The location of any such proceeding shall be the place of sale, Marion County, Indiana.
This contract has been read and is fully understood by both Buyer and Seller
