HEALTH GUARANTEE: Buyer agrees to spay or neuter this puppy no sooner than 1 year of age or the 5 Year Hip and Elbow Guarantee is null and VOID. All puppies will be Microchipped by Seller prior to being placed in their new homes. If puppy is sold prior to the time it is Microchipped at seven weeks, the new owners information shall be applied to that Microchip, along with Seller's contact information as an Emergency Contact. If not sold prior to being Microchipped, Seller's information will be applied to Microchip and a transfer can then be initiated by Buyer upon receipt of puppy and Microchip information. Seller's information is required to remain on the Microchip as an Emergency Contact in order to facilitate the quick return of said dog/puppy to Buyer in the event Buyer cannot be reached at the time of contact. Puppies will not be sold without a microchip.
Seller will provide vaccination record to buyer and guarantees the health of said dog/puppy for three days against puppy viruses from the date it leaves the possession of the Seller. When said dog/puppy leaves our kennel to the best of our knowledge, it is in healthy condition. However, in the event that said dog/puppy should be diagnosed with a medical problem that can be cured, this would not qualify for a replacement. The dog, if shipped, comes to you with a veterinarian’s health certificate and a record of vaccinations except if shipped to the state of California, then health certificate is optional. We recommend that you take the dog/puppy to your own veterinarian (at Buyer’s expense) within the first 3 days for your own satisfaction and protection. You, or your veterinarian, shall report to the Seller any medical problem within the guarantee period. If the dog/puppy is found to have a medical problem it must be reported to the Seller within twenty-four (24) hours of its discovery. ** Failure to make this report within this time frame will void this warranty. If any life threatening condition or congenital defect is found by buyer’s vet upon initial examination that existed prior to buyer taking possession of said dog/puppy, buyer agrees and elects to return puppy immediately for examination and treatment by seller or sellers vet or buyer agrees that buyer will be responsible for all Buyer’s veterinary expenses. Seller will return dog/puppy once treatment is completed or give buyer a replacement dog/puppy.**
REFUNDS, REPLACEMENTS AND EXPENSES: The buyer agrees if puppy/dog is found to have a life threatening or debilitating congenital birth defect, than buyer will accept and elects to take a replacement dog/puppy in lieu of a refund of purchase price, buyer’s veterinarian expenses, shipping charges or any other costs. Under all circumstances if the puppies/dogs health or condition is being questioned, buyer agrees that seller has the right to get a second opinion by a vet of seller’s choice prior to any treatment of said dog/puppy and the right to have seller and or seller’s vet treat puppy/dogs condition unless condition of dog/puppy warrants emergency treatment. Buyer agrees that buyer is responsible for buyer’s veterinarian expenses under all circumstance. There shall be replacement of the dog/puppy only under the circumstances provided below
1) If the dog/puppy is found to be in unsound health with life threatening incurable diseases or viruses by a licensed veterinarian within 3 days, the buyer agrees and elects to return the dog/puppy to Seller, or euthanized upon approval of seller unless seller authorizes other options. Then Buyer may request replacement with another dog/puppy of equal value. Said replacement will be made as soon as a suitable replacement becomes available. A medical report signed by the examining veterinarian must be provided to the Seller prior to a replacement being made. There shall be no replacement unless under the Health Guarantee only as stated below). The Seller will not replace any dog or puppy that has not received adequate and appropriate care from its new owner. It is the responsibility of the Buyer to provide immediate veterinary care (at the Buyer’s own expense) to any dog/puppy showing signs of illness or distress and failure to do so will render any guarantee null and void. Under no circumstance is a dog or puppy to be destroyed with out discussing all options with the seller.. “Unsound health” shall be defined as any condition, which is “life threatening” or “incurable” and shall not include curable conditions such as but not limited to infections, worms, parasites, bacterial infections, skin rashes or an outie belly button (umbilical hernia). Normally this condition is considered cosmetic. Seller will inform buyer if puppy has an outie at which time buyer may choose a different puppy.
2) A replacement puppy will be provided only If said dog/puppy is diagnosed to have a life threatening congenital birth defect within two years of said dog/puppy date of birth by a licensed veterinarian in writing or dies within two years of the dog/puppies date of birth as a direct result of an unknown (at the time of sale) congenital birth defect, only if an appropriate autopsy is performed by a licensed veterinarian and a veterinarian’s certificate is provided as proof of cause of death. Trauma, abuse or neglect will void the guarantee
3) Seller guarantees dog/puppy against debilitating hip and elbow dysplasia for a period of 5 years from the date of birth providing that buyer supplements said dog/puppy diet with 500 – 2000mg of vitamin C daily until dog/puppy is 2 years of age. In other words if said dog/puppy requires surgery or has to be euthanized as a direct result of congenital elbow and or hip dysplasia within a period of 5 years from puppies birth date, buyer is entitled to a new puppy when suitable puppy becomes available upon proof by a licensed veterinarian of surgery or euthanized as a result of dysplasia and proof of dysplasia from OFA at two years of age or the German SV a Stamp Program at 1 year of age). No monetary refund will be given. Seller also strongly recommends that buyer supplement said dog/puppy with Nu-Vet Plus. Seller will provide information about this product to Buyer. ______Initial Here
ADDITIONAL PROVISIONS AND TERMS OF SALE:
1) This dog is being sold as a family pet, and may be shown in nationally recognized breed or performance competition. Buyer agrees to provide for this dog’s emotional and physical care, including annual physical examinations and recommended vaccinations by a licensed veterinarian; nutritious food, positive-reward behavior training; local dog licenses if required; and permanent identification-loss protection either by microchip or tattoo, as recommended by The American Kennel Club. Buyer further agrees that Buyer is solely responsible for any and all actions of the Puppy and agrees to hold Sellers harmless from any and all claims for Bodily Injury and/or Property Damages caused or alleged to have been by the Puppy.
2) Buyer understands that this breed of dog needs special considerations regarding its environment, and agrees to house this dog indoors the majority of time. When outdoors, this dog requires fixed shade, ample safe and clean water supply, and complete and secure fencing, especially when a swimming pool is on premises. No replacement for temperament as this is environmental and buyer(s) responsibility. As responsible breeders we expect that this puppy be properly socialized and attend a puppy obedience classes. As breeders we do everything possible as to breed dogs of sound mind (temperament) and body. Some responsibility is the buyer(s) as to proper feeding, exercise, socializing and training, of which all have a bearing on the end results of a sound adult dog. Seller(s) are not responsible for any damage the puppy might do at any given age.
3) Seller recommends neutering (males) and spaying (females) at age of 18 months, but no earlier than 12 months or as stated previously, the 5 Year Hip and Elbow Guarantee will be null and VOID. ______Initial Here
4 Regarding male puppies, there are no guarantees that the testicles will drop. If that is of concern to buyer, then at the time buyer chooses a puppy, inform seller and seller will inform buyer if testicles are down at that time. At that time buyer can choose another puppy or wait for a puppy from a future litter. Seller will not guarantee that the testicles will stay down at any date past the date of purchase. Buyer agrees that they are satisfied with these terms. ______Initial Here
5) Buyer agrees to inform the seller if/when this dog is moved to another city or state, and the seller agrees, likewise, to inform buyer of any change in location. If this dog is offered for sale or transfer to a third party, other than immediate family, the dog shall first be offered to the seller at the same terms, in writing, and the seller has ten (10) days to accept or reject this right of first-offer. If this dog should, at anytime in its lifetime, need to be surrendered at no cost, the buyer will release this dog to the seller, and its disposition becomes the choice of the breeder/seller. ______Initial Here
