The Sellers, Tim and Bridget McIntosh of Autumn Morning Kennels, and the Buyer, __________________________________, hereby agree as follows:
The German Shorthaired Pointer Puppy described below is sold to the BUYER for the sum of $900.00, received and paid in full this date.

A “puppy” is defined here to be a German Shorthaired Pointer puppy, which is in good health at the time of the sale, and embodies the characteristics of the German Shorthaired Pointer breed. This puppy is purebred and is registerable with American Kennel Club.
The parents of this puppy have had x-rays to establish that they are free of hip and elbow dysplasia.
The BREEDER guarantees the above described puppy to be healthy at the time of sale.
The BREEDER does not assume any liability for any injury to said puppy after delivery.
The BUYER agrees to have this puppy examined by a veterinarian within 72 hours of receiving delivery and send a copy of the examination results to the BREEDER within one week of the examination date.
If the puppy is found to be other than healthy by the BUYER’S veterinarian, it shall be returned to the BREEDER immediately, and the purchase price will be refunded or a new puppy may be selected, or a puppy will be given from a subsequent and comparable litter. Deadline for a refund is 10 days from the date of purchase. The BREEDER will not be responsible for any veterinary bills while the puppy is in the possession of the BUYER.
All appropriate shots for the puppy’s age have been given, and a record of this vaccination history is supplied to each BUYER.
The BUYER agrees to maintain the puppy’s health in good condition, and to provide yearly examinations, vaccinations, heartworm tests, and any other usual procedures necessary to assure good health.
The BREEDER has done everything possible to produce healthy sound puppies both by breeding only dogs that are certified free of hip dysplasia and by raising the puppies in the best way possible in regards to diet, exercise, socialization and veterinary care.
There are many factors that can influence growth and development in a puppy, such as diet, exercise, excessive weight gain, etc. The BUYER assumes the responsibility to carry on with the appropriate vaccinations, exercise and feeding schedule, supplied by the BREEDER. MOST PARTICULARLY, the BUYER agrees to keep the puppy slim throughout it’s normal growth period (the first 2 years of life). The BREEDER can offer no further guarantees once the care of the puppy is no longer under their control.
Regarding Hip or Elbow Dysplasia, the BREEDER guarantees that the puppy is free of hereditary defects to the best of his/her knowledge. Should the puppy be diagnosed by OFA (Orthopedic Foundation for Animals) as being moderately or severely dysplastic on or before 30 months of age, the BREEDER has the option of either refunding the BUYER’S purchase price, or replacing the puppy with another puppy from a comparable breeding. In order for the purchase price to be refunded, the BUYER must present a written certification by a veterinarian of the diagnosis, and submit a copy of the x-ray and OFA report to the BREEDER. The puppy must be genetically dysplastic and the guarantee does not apply to a dog that cannot receive an OFA number due to injury or nutritional deficiency.
If the puppy is found to be defective or dysplastic as described above, then, to qualify for a refund or replacement:
(1) The defective dog must be euthanized by your veterinarian and a letter stating that he/she has done so must be sent to the BREEDER, or;
(2) The dog must be sterilized in a manner preferred by your veterinarian and a letter stating that he/she had done so must be sent to the BREEDER, and;
(3) The dog registration certificate must be returned, with signed ownership of the dog back to the BREEDER.
The BREEDER does not assume any additional liability for possible genetic defects in the puppy, and will under no circumstances be responsible for veterinary bills or testing resulting from such a condition.
The BUYER agrees that neither he/she nor the BUYER’S estate/executors may sell this puppy or transfer ownership of this puppy without the BREEDER’S knowledge and written consent.
The BUYER hereby agrees that if at any time the BUYER cannot take proper care of the puppy, the BUYER must contact the BREEDER and the BREEDER will have the first choice to either: (a) Take the puppy back or, (b) assist the BUYER in finding a suitable home for the puppy.
The BUYER agrees to notify the BREEDER of any changes of address during the puppy’s lifetime.
The BUYER agrees to provide suitable safety measures and / or a fenced area for the puppy while it is outside.
This puppy shall not be bred unless it shall first (1) have been x-rayed and certified clear of hip dysplasia by OFA (Orthopedic Foundation for Animals) or other competent individual or organization, (2) have been certified clear of canine brucellosis, (3) have displayed desirable temperament and obedience, nor shall it be bred to a bitch or dog who does not meet these same three conditions.
The BREEDER neither makes nor implies any warranties or guarantees express or implied, other than those written in the agreement including, without limitation, the warranties of merchantability and fitness. This document constitutes the entire agreement between the BREEDER and BUYER with respect to this sale. Buyer’s signature below indicates that he/she has read, agrees to and does understand the conditions of the Sales Agreement and Contract of Sale.
