Puppy Purchase Agreement/Spay/Neuter Contract
Entered into this _____day of ___________in the year of our Lord_____________ by consenting parties: Gina Ledford (above address) herein referred to as Breeder/Seller and Buyer________________________________________________________________________Address:_____________________________________________________________________Phone_________________Email:___________________________ herein referred to as Purchasing Owner. Puppies born on ______________ sired by _________________________________________ and whelped by ___________________________________________ will be referred to as the ‘puppy’. By their respective signatures, the Breeder/Seller and Purchasing Owner agree to the following terms:
1. The Purchasing Owner understands that the puppy may be named that of choice with the AKC.
2. The Purchasing Owner will take the puppy to a veterinarian within 72 hours upon arrival at their new home. This required visit validates this agreement. If the Purchasing owner for any reason is not satisfied he/she may return puppy for full refund within 3 working days of this signed agreement. Return of puppy must be accompanied by:
A. Written proof from licensed Veterinarian stating the nature of the problem.
B. All registration papers given at time of sale.
C. Puppy must be alive in the same condition it was bought.
D. Courtesy call to inform Tender Creek of the nature of the problem.
By not adhering to required vet visit this contract is made null and void. The Purchasing Owner is responsible for purchasing, daily care, and veterinary costs of the dog.
3. If the Purchasing Owner chooses to give up the puppy, for any reason, the
Breeder/Seller has first right of refusal. You can be assured that your dog will have a home ready in case of unforeseen happenings.
4. The Purchasing Owner agrees to have the dog neutered/spayed (castrated) before the age of 7 months. A copy of the spay/neuter certificate will be mailed to the Breeder/Seller within 2 weeks of the procedure. For puppies that will compete in dog sports such as agility, obedience, flyball, frisbee/flying disc and herding, Spay/neuter can wait until growth plates have closed but no later then 18 months of age. If this contract takes place after the puppy has reached 18 months, required neutering/spaying is extended to 2 years of age.
5. The puppy will be registered with the American Kennel Club (AKC) with the
Purchasing Owner as the listed owner of record. Breeder/Seller elects to use the AKC LIMITED registration program for puppies sold on Spay/Neuter contracts. A copy of the program will be given to Purchasing Owner.
6. Breeder/Seller retains no responsibilities to the puppy other than those specifically mentioned in this Contract. Neither party has liability due to accident or illness nor any disorder that may be caused by environmental factors. . If the puppy has any defects such as, but not limited to, OCD, PRA, CEA, HIP DYSPLASIA, EPILEPSY, BACK DISORDERS, TOXICITY, etc., the Breeder/Seller will not be held liable. As a reputable breeder who stands by her Tender Creek line, however, you may return your puppy with proper documentation, as stated in ITEM 2, and choose a new puppy in exchange. If no puppy is available at time of exchange, you may be put on the waiting list for the next available puppy. Puppy exchange will be based on the Breeder/Seller’s choice.
7. Tender Creek does not guarantee size, confirmation, temperament, nor personality, but does, however, state that we breed with these in mind and strive for show quality puppies. The puppy referred to in this adoption contract is as follows: Sex__________, Color______________, Coat________________, Pattern________________.
8. Purchasing Owner will pay a deposit of $100 in form of cash or PayPal transaction to hold his/her new puppy. Full payment will be due on or before delivery in form of cash or PayPal transaction. Price for said puppy is ___________ plus $200 for shipping and handling (when applicable ______). Deposit will be deducted from Total leaving the final payment in the amount of __________. This amount may be paid in installments or lump sum due on or before delivery. Delivery will be pending based upon flight schedule, but agreed upon by both parties.
WE HAVE READ AND FULLY UNDERSTAND AND AGREE TO ALL SECTIONS OF THIS CONTRACT. WE ACKNOWLEDGE A COPY OF THIS AGREEMENT/CONTRACT.
