The puppy/dog is guaranteed healthy at the time of purchase. The purchaser has 72 hours (excluding Sundays) from the time of purchase to have the puppy/dog examined by his/her veterinarian as to soundness of health. If the veterinarian finds any major health problems, the cause, which is clearly attributable to the breeder, the purchaser may bring the puppy/dog back to the breeder, with a letter from the veterinarian explaining the problem he/she found.
The breeder must be contacted within the 72 hour period after purchase as to any problems, and the puppy/dog must be returned within 4 days of purchase, at this time the breeder will, upon receipt of the puppy/dog and all items given with the puppy/dog (including the AKC papers to be signed back to the breeder) refund to the purchaser the full purchased price of the puppy/dog, by check.
Any veterinarian's diagnosis shall be subject to confirmation by a veterinarian chosen by the breeder. Should said veterinarian not agree with the diagnosis, the matter shall be presented to a third veterinarian mutually agreed upon by the breeder and the purchaser.
The puppy is sold with a 10 (ten) day return policy and full refund of monies paid for the puppy if for any reason the buyer decides the puppy does not fit their expectations. All expenses to return the puppy will be the responsibility of the buyer. The puppy must pass a health check by the seller’s veterinarian prior to the money being returned.
As a breeder/seller, I have done everything possible to guarantee the eye lines of the above puppy/dog that you are purchasing. But I cannot be held responsible if something should develop in the eyes of the above-mentioned dog/puppy. All CERF’s have been done on the parents to insure that the offspring gets the best eyes possible, but with this breed as other breeds, there is no guarantee that that is enough. I do require that the buyer has the eyes of this dog/puppy CERF’d each year and copies of the CERF sent to me and registered with the CERF Association.
The puppy/dog must be spayed/neutered by the age of six months and before a female has her first heat. The breeder has the right to co-own or hold the registration papers until the buyer has sent to the breeder a written receipt from the veterinarian as to the spaying or neutering of the puppy/dog. At that time the breeder will sign over full ownership to the buyer. The owner has the right to bring the puppy/dog back to the breeder for evaluation before he/she is spayed/neutered.
The breeder reserves the right to inquire about and inspect the way the puppy/dog is kept. If the puppy/dog is mistreated (allowed to run loose, left in unsanitary conditions, unhealthy, etc.) the breeder has the right to take the puppy/dog from the owners with no compensation to the owner. The owner will be required to sign the papers over to the breeder.
The breeder is to be notified if the owner moves, or if the owner cannot keep the puppy/dog for any reason. The breeder has first option to take the puppy/dog back from the owner. If the breeder does not want the puppy/dog the breeder is to be notified as to the new owner's name, address, and phone #. The owner is to have the new owner sign this agreement and mail a copy back to the breeder.
The breeder is not responsible for any veterinarian bills or other bills the owner may incur after purchase of the puppy/dog.
Puppy/dog is to be registered using the breeder’s kennel name-D’Va-at the beginning of the registered name.
It is agreed by the buyer that the above-mentioned puppy, will not be sold to any owner, employee, agent or individual connected with a pet store or wholesaler of dogs or surrendered to a humane society or rescue group. In the event that the buyer is responsible for the sale of this dog to the above-mentioned organizations, the seller shall have recourse in the courts of Hall County, Nebraska for damages to their name and reputation in the financial sum of $5000.00(Five thousand dollars). The buyer will be responsible for all attorney fees; court costs and traveling expenses to return the dog back to seller.
I, the purchaser, have read and understand the terms of this guarantee/agreement. I also understand that if I do not uphold my part of this agreement, the breeder has the right to take the puppy/dog back at no compensation to the purchaser.
