BREEDER/BUYER CONTRACT
I, Tiffany Yeary the Breeder, and ______________________________, the Buyer(s), do hereby agree to all of
the following conditions of sale for ___ (#), ______ (sex) _____________________ (color), _______ quality
puppy from the __________________________ (Date) litter of
__________________________________________ (Dam) and
____________________________________ (Sire), on this the _____ day of _______, 200__.
BREEDER AGREES TO THE FOLLOWING:
The puppy(iesâ ™)yâ ™s has been given first modified live Parvo virus shot at six weeks of age and all
required shots needed for the puppy(ies) age at the time of sale. That the Breeder, assures the Buyer that the
litter was in good health (unless contrary information is disclosed), that the pups are full blood Cocker
Spaniels and were, by the age of 6 weeks, given at least their first modified live Parvo virus shot(s) and dose
of worming medication and that the pup(s) has (have) been given only the best of care from the time of birth,
and as of this day (as written above) and relinquishes all rights to above stated pup(s).
BUYER AGREES TO THE FOLLOWING:
That the Breeder will grade the litter for future potential and that such grading must be considered an
educated guess at best, and that the Buyer must understand that breeding quality, certification or show
quality is not guaranteed. That since it is impossible to predict the future of a pup, there are no other
warranties or guarantees either written or implied with the exception of the Health Guarantee that may or may
not be supplied to the Buyer by the Breeder at the Breeder’s sole discretion. That I (we) the Buyer(s) agree to
provide all proper and necessary health and environmental maintenance for above listed pup(s) from the day
of sale to the day of the pup(s)â ™s natural death, and that if there is ever a day that I (we) cannot provide
such care, that I (we) will immediately contact the Breeder to return the dog to the owner at my cost or to
inform the owner that the dog is being put down for health reasons accompanied by a written vet
assessment of reason, and will provide written explanation for either reason for record keeping purposes by
the Buyer(s). That I (we) the Buyer(s) will either spay or neuter pup(s), and that we agree that we are not a so
called â śPuppy Millâ , and will never sell, lease, raffle, cosign, loan or let the pup be borrowed by a person,
more than one person or any company, organization or corporation for the purposes of â śPuppy Millâ
breeding or physical, emotional or any other kind of testing that has the potential of injury. That I agree that
the dog shall be kept inside the Buyer’s home, in a fenced area or walked on a leash and NEVER be left tied
up or chained outdoors or knowingly allowed to roam unattended. That I the Buyer agree that by signing this
contract I understand that there will be no refund or compensation of any kind, regardless of the
circumstances. That I the Buyer agree to allow the Owner or Owner’s representative to visit the dog if at any
time it is suspected that the dog is being abused and will allow the Owner or Owner’s representative to take
the dog if abuse is determined by the Owner or Owner’s representative and that I will immediately sign over
forever the rights to ownership to the dog back to the Owner immediately and that all paperwork, ownership
and registration paperwork pertaining to the dog will be relinquished to the Owner or Owner’s representative
immediately and permanently if such abuse is determined. I further agree that I will never sell or give-away
the dog, and that if there ever comes a day when I cannot properly care for the dog I will return the dog to the
Owner at no cost to the Owner whatsoever regardless of distance or difficulty. I agree that I will get the pup
checked by a veterinarian within 3 days from pick up or delivery and that if on initial check the Vet certifies in
writing that the animal has a health defect that would warrant euthanasia, the breeder will replace this animal
with one of equal value and quality as soon as one can be made available and the breeder reserves the right
to as much as 2 years to provide such replacement. NO REFUNDS, NO EXCEPTIONS! Animal is guaranteed
for 1 year on a replacement basis only against congenital defects. No other adjustment will be made and
breeder is not responsible for any veterinarian bills incurred by the buyer. Buyer agrees to hold breeder
harmless for any liabilities incurred by the buyer. Breeder will not accept animal for replacement due to ,
Allergy, Landlord-Tenant dispute, Marital, or propensities of the animal but does require that if any of these, or
any other life situations occur that would put the pup into any less than an optimal environment occurs, the
pup must be returned to the breeder immediately and permanently at no cost to the breeder whatsoever and
no replacement will be given. The breeder does not guarantee against any environmental temperament
problems, most often caused by abuse, neglect, teasing, or failing to provide appropriate training and
socialization.
I, THE OWNER AND I THE BUYER AGREE TO ALL THE TERMS OF THE ABOVE CONTRACT, AND AGREE
TO BE BOUND BY ALL STIPULATIONS WITHIN IT WITH THE UNDERSTANDING THAT THE CONTRACT
WILL NOT BE FILED UNLESS BREECH OF CONTRACT OCCURS.
