1. Buyer agrees to obtain a veterinary examination by her veterinarian of “Puppy/Dog” within three (3) days after arrival at Buyer’s residence. Puppy/Dog is guaranteed to be of good health and free of infectious disease(s) ten (10) days from the date of arrival of Puppy at Buyer’s residence. The Breeder/Seller guarantees this Puppy/Dog to be free from presently known inherited defects, and will replace the Puppy/Dog with one of similar quality should such a hereditary defect be diagnosed, in writing, at any age, by a qualified veterinary specialist. Although there is no clear genetic link with regard to malignant cancer, the Breeder/Seller will also apply this same guarantee to this condition up to the fourth (4th) year of the Puppy’s/Dog’s life.
2. If at any time the Buyers named above wish to dispose of this Puppy/Dog, Buyers shall first offer Puppy/Dog for sale to Breeder/Seller by registered mail to Monica E. Barry, for a dollar amount not to exceed Puppy’s/Dog’s original purchase price. Breeder/Seller bred this Puppy/Dog and he is always welcome back to the place of his birth where he will spend the rest of his days.
3. At no time shall this Puppy/Dog be disposed of to a pet shop, dog dealer, agent of either or to anyone who does not sign an agreement precluding such a sale. The name of any new owner shall be provided to the Breeder/Seller in writing together with a copy of the above mentioned agreement.
4. No offspring of said Puppy/Dog shall be sold to a dog dealer, pet shop, or agent of either.
5. This Puppy/Dog shall be maintained on an adequate enclosed area, or on a leash, and not be allowed to roam at will.
6. If this Puppy/Dog is being sold as a “show prospect” he/she is guaranteed to be free from physical defects which would hamper his/her ability to finish his/her conformation title. These defects include a bite that is neither scissors nor level at two (2) years of age, three (3) or more missing teeth, one or more missing testicles if male, not being of standard size/stature as measured at the shoulders, poor structure and/or movement that would qualify him/her as pet quality after two (2) years of age. The guarantee for movement shall not apply to physical injuries sustained by the Puppy/Dog while in the Buyers's care and custody. This lack of quality is to be determined by the Breeder/Seller. If there is disagreement between the Buyers and Breeder/Seller of the Puppy/Dog, this determination of quality shall be made by two (2) known Borzoi breeders who are also AKC licensed judges. The choice of these judges shall be made by both the Buyers and Breeder/Seller who will each pick one (1) Borzoi breeder/judge. In the event that the Puppy/Dog is determined to be pet quality, the Buyers may return him to the Breeder/Seller in exchange for a replacement puppy or elect to keep him/her in addition to accepting a replacement puppy/dog. The replacement puppy/dog shall be the pick puppy/dog from the next litter bred by the Breeder/Seller after the stud fee puppy and/or litter's co-breeder fee puppy, if applicable, have been selected. If there are no suitable puppies in the litter, the replacement shall come from a subsequent litter that the Buyers deems acceptable.
7. This Puppy’s/Dog's parents are friendly, outgoing, and mentally sound animals with outstanding temperaments. Even with this genetic strength, proper socialization is necessary. The Buyers agrees to socialize the dog by whatever means she is able to ensure that the Puppy/Dog will be the happy, secure, confident, socially functional adult she has the potential to become. If, after the Buyers has made adequate effort to acclimate the Puppy/Dog to new people and animals during the first year of his life, the Puppy/Dog is aggressive toward humans and other dogs, the Breeder/Seller shall apply the same requirements for replacement as outlined in Section 6.
Both Breeder/Seller and Buyers agree to accept all legal consequences for violation of the above terms.
