AGREEMENT TO PURCHASE GOLDEN RETRIEVER

Sex of Dog:
1. The above described dog of the above described Sire and Dam has been sold by Breeder to Buyer____________________ as a pet quality dog for $1,250. Buyer agrees to have this dog spayed/ neutered by a licensed veterinarian between 4 and 12 months of age, the cost of which will be paid for by Owner. This dog is sold on Limited Registration and the Buyer understands that any progeny of this dog cannot be registered with the American Kennel Club.
2. The dog is sold on a seven day trial period, during which time the Buyer agrees to have the dog examined by a licensed veterinarian at Buyer's cost. If buyer is not satisfied with the health of the dog within seven days of purchase, the buyer may return the dog to the Breeder for a full refund (shipping excluded), provided the dog is in substantially the same condition as when sold.
3. Buyer agrees to use the Breeder's kennel name, Mattiaci, in registering this dog with the American Kennel Club.
4. Reasonable precautions have been taken to prevent this puppy from acquiring hereditary faults such as hip dysplasia and hereditary cataracts and heart murmurs. The sire and dam have hip, eye, elbow and heart clearances. Due to the unknown hereditary and environmental causes of such faults no guarantee for the puppy will be given against them. Clearances on both the sire and dam help reduce the risk of progeny developing problems in the future but is no guarantee.
5. Buyer agrees to notify Breeder promptly of any change of address or phone number. If at any time during the life of this dog Buyer is unable to keep dog for any reason, Breeder has first choice to repossess the dog at Breeder's cost, but subject to Buyer's obligations to paragraph numbered 6. Below and the liquidated damages provision in paragraph 8. below.
6. Buyer shall take care of this dog in a responsible, humane way i.e.: the dog may not be found constantly running loose off Buyer's property, Buyer shall provide adequate medical and nutritional care for the dog and Buyer may not abuse this dog, permit any other person to abuse this dog or place the dog in any harm or danger. Buyer may not breed this dog to other breeds. Breeder retains the right to repossess the dog if buyer does not comply with any of these obligations, and if Breeder chooses to repossess the dog for Buyer's failure to comply with these obligations, in addition to Buyer's other remedies allowed by law or stated in paragraph numbered 8 below, Buyer shall also sign over AKC papers over to the Breeder.
7. Breeder may also repossess this dog if this dog has been bred.
8. Damages for Buyer's noncompliance with any of these terms of this agreement are agreed to be in the amount of $2000, plus reasonable attorneys fees, as well as actual costs and attorney fees incurred in the collection of the same. Any litigation or arbitration regarding this contract will occur in Powell County in the State of Montana.

Full price of puppy is $1,200 for pet $1,800 for show/breeding quality. Difference between deposit and full price can be paid anytime after the puppy is born and must be paid before puppy is shipped/picked up, or by the time the puppy is 8 weeks of age. Boarding past 8 weeks of age will be at $3/per day for the first month and $7/per day after the puppy is 4 months of age.
All vaccinations and any routine or emergency veterinary care costs after 8 weeks of age are the responsibility of the Buyer.
Buyer fully understands that pet quality puppies are sold on spay/non-breeding contracts with AKC Limited Registration - any progeny from the above described dog is not registrable with the AKC. Reservations will be filed in order of date received.
