Owner Contract
The new owner contract shown is a sample posted by this member as a representative of the agreement you would enter into prior to obtaining a puppy/dog from this breeder. It is not, nor does it imply, a contract with or guarantee by QualityDogs.com, endorsement by QualityDogs.com of this contract, or any responsibility, express or implied, by QualityDogs.com. The breeder listed is solely responsible for the content of this contract and its satisfaction. For your protection, QualityDogs.com recommends obtaining a printed, signed copy of any contract.

I. Health & Grace Period

a) Buyer has the right to, and is advised to by the breeder, to have this Cane Corso Italiano examined by a veterinarian of their choice within 7 days of arrival.

b) Should the purchasers decide to not keep the Cane Corso Italiano, for other than health reasons, they have a seven day grace period to return it and shall receive a refund with the return of the healthy Cane Corso Italiano, minus transportation expenses to return the dog to the breeder.

II. General Terms

a) I/We do hereby state that:
- this Cane Corso Italiano is being purchased as a companion and shall be provided for as a member of the family.
- this Cane Corso Italiano will be fed and have appropriate housing
- this Cane Corso Italiano will have access to ample fresh water
- this Cane Corso Italiano will have companionship on a daily basis
- this Cane Corso Italiano will receive appropriate veterinary care when needed

b) I/We have been instructed by the breeder that socialization is extremely important in the proper rearing of a Cane Corso Italiano to become a temperamentally stable adult dog and canine good citizen. I/We by the signing of this contract, do hereby make absolute promise that
- this Cane Corso Italiano will receive socialization with people and dogs on a regular basis
- this Cane Corso Italiano will be trained in basic obedience (preferably trained with a professional trainer familiar with Molosser breeds.)

c) I/We do hereby agree that this Cane Corso Italiano is not being purchased for nor will be involved with any illegal activities. I/We are not purchasing this Cane Corso Italiano for a third party, broker, or pet store. If this Cane Corso Italiano is found to be involved in such transactions or activities, I understand that Seller has the right to take possession of the Cane Corso Italiano and that Buyer will not be entitled to replacement or reimbursement.

d) Should, at any time, this Cane Corso Italiano be mistreated by reason of abuse or neglect the breeder reserves the right with substantiated proof to take back immediate possession of the dog without reimbursement to the owner. Should this clause need to be enforced, the owner shall forfeit all rights to the dog. All records and papers in relation to the dog (including registration papers) are to be turned over to the breeder within 7 days of the breeder taking possession.

d) I/We do hereby agree that the Breeder retains the right to visit, or have someone visit the dog periodically for the purpose of determining what the litter produced or just to check on the dog’s welfare.

III. Terms of Ownership

a) Buyer agrees to never sell or place this dog for resale, gift or prize or to a broker/agent or pet store for resale in a pet shop, shelter, ASPCA or any other organizations for unwanted animals. Buyer will not sell or place this dog in a research laboratory, or with someone who has the sole intent of using the dog for breeding purposes or for use in illegal activities. If Buyer is unable to or no longer wishes to retain custody of the dog [for any reason], Seller must be notified first and will reserve the right to first refusal of the dog. The right of first refusal shall be for the period of the dog's lifetime. Should the dog be sold at any time without contacting the seller first, buyer will be held responsible for any and all expenses for the seller to reclaim the dog.

IV. Type, Health & Temperament Guarantee

Should within 36 months of age, the Cane Corso Italiano not pass or develop any disqualifying faults as described in the FCI Cane Corso Italiano standard, or be diagnosed with any genetically derived medical disorder (ex. Bi-lateral HD) which is attested to by two unassociated veterinarians thereby causing Buyer and Seller to agree that the Cane Corso Italiano cannot ethically be bred, upon provision of veterinary reports, critiques or video and, where applicable, OFA or PennHIP reports, Seller will provide Buyer with the options below.

Buyer has the choice to keep the Cane Corso Italiano with proof of spay/neuter or return the Cane Corso Italiano to Seller, upon this decision, Seller will offer a replacement Cane Corso Italiano or 50% of the original purchase price in the following manner:

A corresponding quality puppy from Seller’s next litter will be assigned to Buyer, Buyer has the right to choose:

a) Replacement: Should Buyer choose to accept the replacement Show Quality puppy, Seller will provide Buyer with the replacement Show Quality Cane Corso Italiano in Seller’s next litter upon proof of Spay/Neuter or relinquishment of the original Cane Corso Italiano.
b) 50% of Purchase Price: Seller will sell the assigned Show quality puppy and will refund 50% of original purchase price less any shipping or miscellaneous charges associated with transportation of Cane Corso Italiano to Buyer upon proof of Spay/Neuter or relinquishment of the original Cane Corso Italiano.

In the case of CHD:

Seller will entertain no warranties prior to the age of 18 months unless the veterinarian believes the condition is severe. This is because hip structure can change and may not be set until fully mature.

A rating of Borderline or Mild on the initial submission to OFA will not qualify the dog as being affected with HD. The dog must be reevaluated and resubmitted in six months. If at that time, it does not receive a passing rating then the dog will be replaced as per the terms above.

This guarantee shall be absolutely null and void no matter whether show, breed or pet quality, if the dog has been given calcium or vitamin supplementation of any kind, any "forced" exercise (no jumping from, on or over anything taller than the dog’s shoulder, no extended walks, no excessive running, etc) until a minimum of 15 months of age, that has not been first agreed upon, stated in writing, signed and notarized by the breeder; even if recommended by a veterinarian and no other excuse shall be valid.

TEMPERAMENT:
Should this Cane Corso Italiano exhibit aggressive behavior which Buyer deems intolerable and irreversible within 24 months after purchase, Buyer will provide Seller with proof that this Cane Corso Italiano has been sufficiently socialized and that obedience classes and other structured training methods have been attempted with no results. Upon receipt of such proof, evaluation of this Cane Corso Italiano will be scheduled with an agreed upon trainer or breeder with knowledge of this breed and temperament. Should the Cane Corso Italiano be deemed overly aggressive by the chosen breeder/trainer, Seller will arrange for euthanasia of this Cane Corso Italiano and provide Buyer with a replacement corresponding quality puppy as soon as such a puppy is available to Seller, or a refund of 50% of purchase price.
Seller shall not be held responsible for acts of Puppy which are due to Buyer's negligence.

This type, health, & temperament guarantee shall be absolutely null and void no matter whether show, breed or pet quality, if the dog has been bred.

Seller shall not be held responsible for the development of non-genetically disqualifying faults, diseases, or disorders, which are due to Buyer’s negligence.

Buyer is responsible for all fees for transportation of the original or replacement to and from Buyer and Seller if applicable.

Note: If this Cane Corso Italiano is euthanized without written consent from the Seller as noted in Section III. e) any guarantees are then null and void and you forfeit any rights to replacement or monies back.

V. Show/Breed Quality Breeding Terms

Buyer agrees to the following terms of breeding:

Males are not to be bred unless he is a minimum of 12 months

The buyer agrees not to use this male in any breeding program, nor offer stud services to any breeding program that will exceed (8) eight litters of puppies in any 24 (twenty-four) month period. Seller recommends that this Cane Corso be health tested (hips, elbows, etc) before being used for breeding.

Females are not to be bred unless she is a minimum of 22 months of age.

Female should not be bred after the age of 8 (eight) years. The buyer agrees to skip a heat between breedings to allow this female time to recover unless the litter is stillborn or consists of 1 (one) puppy. Seller recommends that this Cane Corso be health tested (hips, elbows, etc) before being used for breeding.

He/she will never be bred to any other than a respectable specimen of his/her own breed, always keeping in mind the betterment of the breed. With this in mind, he/she is only to be bred to Cane Corso Italiano that have proper paperwork with an FCI affiliated kennel club (ENCI, FCPR, etc) or CCPS.

He/she is never to be bred to a dog of another breed.

Buyer agrees that any offspring produced from this dog will be sold to homes that have been screened and are believed to be interested in the protection and promotion of this breed, which will agree to provide proper nutrition, care and training for the dog.

No offspring of this animal may be sold or placed for resale, gift or prize or to a broker/agent or pet store for resale in a pet shop, shelter, ASPCA or any other organizations for unwanted animals. The buyer will not sell or place offspring of this Cane Corso Italiano in a research laboratory, or with someone who has the sole intent of using the dog for crossbreeding purposes or for use in illegal activities.


VI. Pet Quality must be altered (spayed/neutered).

Proof of spay must be sent to breeder in the form of a copy of the spay/neuter certificate issued and signed by Buyer's Veterinarian.
