Our PET Puppies are sold on Limited contracts. If Looking for Breeding & Show/Competition stock quality will sell on a open contract for breeding but must be proven in AKC or NAVDHA titles and must pass OFA or Penn HIP, Elbows, Cardiac and Eye Cerfs also must be bred to Sire or Dam with same qualifications.

PUPPY PURCHASE AGREEMENT LIMITED
The following constitutes the Purchase Agreement of a (male/female) German Shorthair Pointer Puppy (herein described as “GSP”) by and between the Breeders, Cathy A. Fleming (herein described as “Breeder”) and the Buyer(s), __________ __ (herein described as “Buyer”). This litter was whelped on ___________________ and is a result of a mating between (SIRE NAME & DAMS NAME.
The Health Certificate, herein provided to the Buyer at the time of sale, is a declaration that a Veterinarian examined this puppy on ___________, was found to be in good health and is up-to-date on all inoculations.
The purchase price for said (male/female) GSP puppy is price of dog Plus Shipping and Crate and is subject to the Terms and Conditions of this Agreement.
This puppy may be returned to the Breeder for any reason within 48 hours of the date of this agreement and the full purchase price will be refunded. After said 48 hour time period elapses, the Breeder may retain a portion of the purchase price, specifically price of deposit , which will serve to compensate the Breeder for the inconvenience of turning away other potential buyers.
The name of this (dog/bitch), eligible for registration with the American Kennel Club (herein described as “AKC”), must be prefaced with our kennel name, specifically Cady Falls. The Breeder and the Buyer will prepare the AKC registration application papers at the time of sale and the Buyer agrees to provide the Breeder with a check to cover the cost of said registration application. The Breeder will then mail the application and fee to the AKC and the AKC will mail the registration certificate to the Buyer.
The Breeder certifies that the Dam, (name of dog) has been cleared for:
1. Hip Dysplasia and rated “good” by the Orthopedic Foundation for Animals (herein described as “OFA”),
2. Eye abnormalities and rated “normal” by the Canine Eye and Registration Foundation (herein described as “CERF”),
3. Heart abnormalities and rated “normal” by the OFA-Cardiac Registry (herein described as OFA-Cardiac) and
4. Elbow abnormalities and rated “normal” by the OFA-Elbow Registry (herein described as OFA-Elbow).
The Breeder certifies that the Sire, (NAME OF DOG)
5. Hip Dysplasia and rated “(GOOD)” by the Orthopedic Foundation for Animals (herein described as “OFA”),
6. Eye abnormalities and rated “( Clear )” by the Canine Eye and Registration Foundation (herein described as “CERF”),
7. Heart abnormalities and rated “(NORMAL)” by the OFA-Cardiac Registry (herein described as OFA-Cardiac) and
8. Elbows are rated (NORMAL) by the Orthopedic Foundation for Animals (herein described as “OFA”),
The Breeder guarantees that the Sire and Dam of this (dog/bitch) are both DNA registered with the AKC. This (dog/bitch) will be DNA registered to furnish absolute proof of identity and parentage with the AKC. The Breeder will collect a cheek swab from the (dog/bitch) and will send it to the AKC for registration. The Breeder included DNA cost into the purchase price of the puppy. The Buyer will forward a copy of the DNA certificate to the Breeder when it has been returned and will keep the original for their own records.
A Veterinarian/Breeder will provide the (dog/bitch) with permanent identification via Microchip insertion and the Breeder and the Buyer will prepare the registration documentation at the time of sale. The Buyer agrees to pay the cost of this service for a total of $_0- included in purchase price. The Buyer may choose an addition method of permanent identification by professional Tattoo placement of the (dog’s/bitch’s) AKC registration number; however, it must be done at the Buyer’s own expense.
The Buyer agrees to be responsible for the following:
1. agrees this (dog/bitch) will live its entire life by being cared for in a responsible manner,
2. agrees that this (dog/bitch) will receive regular and appropriate “well-dog” Veterinary care including but not limited to an annual examination, inoculations and preventatives as well as emergency treatment for any unexpected medical crisis,
3. Agrees that this (dog/bitch) will be fed a high quality dog food, ( Nutro lamb and rice Eukanuba, Bil Jac, Canidae, Iams, Chicken Soup for dogs and not limiting you to these brands just High quality dog food,
4. Agrees that this (dog/bitch) will be maintained in appropriate condition for Showing, Hunting, Field, Obedience, Agility or any other activity or competition therein,
5. agrees that this (dog/bitch) will sleep in the home on a year round basis,
6. agrees that this (dog/bitch) will be kept out of harm’s way and in a humane manner when not under the immediate supervision of the Buyer. For example: the (dog/bitch) will NOT ride in the open bed of a pick-up truck, will NOT be on a standard tie-out (with or without a cable), etc. A metal or enclosed cage/crate will suffice for the riding in a vehicle and a fenced yard, kennel run or invisible fence will constitute responsible containment.
7. agrees that this (dog/bitch) will be treated in a loving, caring and humane manner and will live as part of the family environment.
The Buyer further agrees to properly socialize the (dog/bitch) by exposure to various environments and experiences. Specifically, the Buyer and the (dog/bitch) will partake in introductory obedience classes by the age of 14 weeks so that both handler and canine will receive professional assistance in training and behavior.
The Buyer agrees that this (dog/bitch) is being sold on a LIMITED REGISTRATION will not be used for breeding. This (dog/bitch may not be used for breeding is being sold as a pet puppy only. If breeding takes place, this act will constitute harm to the reputation of the Breeder and the Breeder may seek damages in a court of law.
The Breeder and the Buyer agree that this (dog/bitch) is being sold on a Limited Registration and will be only a PET PUPPY. This does not mean that this (dog/bitch) cannot compete for titles under this Limited Registration. Buyer agrees that the (dog/bitch) will be (spayed/neutered) at the Buyer’s own expense. The Buyer then agrees to provide the Breeder with a Veterinarian’s certification of (spaying/neutering). The (dog/bitch) will not be (spayed/neutered) until after the age of 6 months old.
If Buyer feels said (dog/bitch) is Quality for breeding must get written consent and changes in Limited Agreement from the Breeder (Cathy A Fleming & James T Fleming Jr) and must follow the Breeders Breeding Guidelines.
The Buyer agrees that this (dog/bitch) will not be used for breeding without obtaining prior approval from the Breeder. A bitch may not be bred until after the age of 2 years old. If breeding takes place without express Breeder permission, this act will constitute harm to the reputation of the Breeder and the Breeder may seek damages in a court of law.
The (dog/bitch) to be bred must be free of joint, eye, heart and elbow abnormalities through certification by the OFA, CERF, OFA-Cardiac and OFA-Elbow. The Buyer agrees to breed only to a (dog/bitch) that has the same certified health clearances. Further still, this (dog/bitch) may not be bred until it has achieved individual accomplishments. Such accomplishments may be the realization of an AKC Show Championship, an AKC Field Championship, an AKC Hunt Test title or any other recognized championship or title therein. The Buyer recognizes that breeding is a lifetime commitment and as such agrees to take responsibility for future placement of the (dog/bitch) and its offspring.
The Buyer agrees to provide the Breeder with the following information for maintaining breeding records:
1. height at the shoulders and
2. weight at 6 months of age and then again at 1 year of age.
The Buyer also agrees to provide the Breeder with photographs that clearly illustrate the right and left sides and the front and back of said (dog/bitch) at 6 months of age and then again at 1 year of age
This (dog/bitch) is being sold as a (Pet Puppy/Hunting/ Obedience/Agility) “prospect” and on a “Limited” AKC registration. While this does not guarantee that (he/she) will be able to attain such Titles/ Championship in any competitive arena, it is, at this time, the considered opinion of the Breeder that this (dog/bitch) exhibits the qualities to engage in any such events if the Buyer wants to do so under Limited Registration.
If at any time during the life of this (dog/bitch) the Buyer is no longer able to maintain ownership, the Buyer agrees to present the Breeder with the option of “First Right of Refusal” before exploring other ownership options. Specifically, the Buyer will offer the Breeder the option of ownership and compensation by the Breeder, IF any, will not exceed the purchase price even if the (dog/bitch) has accomplishments.
THE VIOLATION OF ANY OF THE ABOVE TERMS AND CONDITIONS OF THIS AGREEMENT CONSTITUTE IMMEDIATE GROUNDS FOR REPOSSESSION OF THE (DOG/BITCH) BY THE BREEDER.
