Owner Contract
The new owner contract shown is a sample posted by this member as a representative of the agreement you would enter into prior to obtaining a puppy/dog from this breeder. It is not, nor does it imply, a contract with or guarantee by QualityDogs.com, endorsement by QualityDogs.com of this contract, or any responsibility, express or implied, by QualityDogs.com. The breeder listed is solely responsible for the content of this contract and its satisfaction. For your protection, QualityDogs.com recommends obtaining a printed, signed copy of any contract.


PUPPY PURCHASE & SALE AGREEMENT

This contract represents full agreement by both Buyer and Seller for all of the following terms and conditions for the purchase of a (color, sex) Portuguese Water Dog puppy for the purchase price of $2750.00. A non-refundable deposit of $500.00 will reserve your puppy and will be applied to the full purchase price of the puppy due at transfer. In the event that the Seller is unable to supply you with a puppy that meets your selection criteria, your deposit will be refunded. Puppies will not be shipped as "cargo", but may be escorted as in-cabin "carry-on" only. Transport costs are the responsibility of the buyer.
Puppies are sold as pet/companion unless otherwise agreed upon by both parties and will be required to be spay/neutered at an age determined appropriate by your veterinarian.

Position in the reservation order is determined by order of deposit received and after prior "pick" commitments for this breeding have been met by the Seller.

BUYER'S OBLIGATIONS:
This puppy will be registered with the American Kennel Club (AKC), with a limited registration, exclusively on verification to Seller of socialization and obedience training.

The Buyer agrees to register and advertise this puppy with appellation relevant to the breeding, within their elected registered name. That is, "Bella" must appear as "Washashore's Bella, or Bella of Washashore" on all registration paperwork as well as any advertising and marketing done using this dog. All dogs bred by Washashore Portuguese Water Dogs, must bear this name or the contract may be considered void and the dog returned to Seller. The Buyer agrees that the Seller may continue to use the dog's name, pictures and/or information in advertising the kennel or other dogs.

It is the Buyer's responsibility to have the puppy examined by a qualified veterinarian within a 48 hour period of transfer. If the veterinarian deems this puppy to be seriously ill, diseased or physically unsound, it must be returned within a 48 period after these findings, with the veterinarian's report, and your payment will be refunded or Seller will replace the puppy, with a puppy of equal quality when one becomes available (not necessarily from the same dam and/or sire).




The Buyer accepts responsibility for the care of this dog, appropriate accommodations and agrees that a yearly veterinarian examination will take place, required/recommended vaccinations, heartworm and Lyme disease preventative will be given. The puppy will be maintained on a proper diet and weight controlled to avoid obesity that will void the health guarantee. The puppy will undergo regular grooming as required for the breed to ensure a healthy coat and to deter matting. The dog will be confined in a suitable fenced yard, will never be chained, tied out, or kept on a run, nor will this dog be allowed to roam free. When left unattended, the dog will be crated/kenneled or penned for its safety until deemed "safe/trust-worthy" by the Buyer. Portuguese Water Dogs are physically and mentally "energetic" animals and require regular daily appropriate exercise to maintain a healthy body and mind. They are an interactive breed and do best when involved with owners rather than left alone. Physical activity should be supervised and limited to minimize risk of injury to the growing puppy. Exercise sensibly and appropriately for the age of this puppy. Play with large breeds may result in injury of this puppy and should be avoided until the age of two (2) years and always supervised closely.

Buyer agrees to attend and successfully complete a puppy training & socialization class/obedience course of at least 8 weeks, one hour sessions, prior to 6 months of age. The Buyer will send the Seller a copy of the graduation certificate upon completion of the course(s). Socialization and training is an ongoing process and the Buyer agrees to continue this throughout the life of this puppy.

If for any reason the Buyer is unable to keep the puppy, it will be returned to the Seller and ownership will be transferred to the Seller. Any demonstrable neglect, abuse or illegal activity involving this puppy, is subject to immediate forfeiture to the Seller.

This puppy will not be purchased for resale, sold, leased, consigned or transferred to another person, or any commercial/retail establishment/broker of animals other than the Buyer. It will not be trained for activities illegal or those not suited by reason of temperament or conformation, used as a guard or attack dog, or to hunt or fight other animals.

In the event that this puppy expires prematurely from unexplained etiology, a necropsy must be performed to determine if the cause of death was due to a pre-existing congenital or acquired condition. The Buyer will contact the Seller and provide the Seller with the necropsy report with all pathological findings for submission to the PWDCA health data base within 2 weeks from the date of the necropsy.
Financial responsibility for necropsy and veterinary expenses are the sole responsibility of the Buyer.


In the event of breach of this agreement, the Buyer agrees to pay all expenses of retaking, holding, preparing for sale, selling, and expenses as may be allowed by law and incurred by the Seller in enforcing his/her rights under this agreement. The dog may be subject to forfeit if the Buyer does not fulfill his/her obligations. In the event that litigation occurs concerning this contract, the Buyer is responsible for any/all associated fees/costs.

SELLER'S OBLIGATION:
The Seller believes the puppy to be in good health, of sound body and stable temperament/disposition at the time of transfer to the Buyer. The puppy has been evaluated by a qualified veterinarian and deemed to be in good health, has received vaccinations appropriate for its age, dew claws removed, has been wormed, micro-chipped, temperament tested and eyes checked by a licensed Ophthalmologist. As environment plays an important role in the puppy's development and disposition, the Seller cannot be responsible for any undesirable traits the dog accrues after transfer to the Buyer. This puppy has been well-socialized to its age-appropriate level.

Seller agrees to supply the Buyer with a signed limited individual puppy registration form for the AKC Registry after receipt of verification of socialization/obedience training. Health certificates and pedigrees for both sire and dam will be furnished to the Buyer at the time of transfer.

The puppy is guaranteed for the purpose of a pet/companion animal, guaranteed against any form of severe genetic health defects for one year from the date of birth, and against crippling, bilateral hip dysplasia for a period of two years a from date of birth. This guaranty is null and void if the Buyer has failed to comply with terms of the contract, has shown negligence or abuse in the care of the puppy or the dog becomes obese. If either of these conditions exists within the allotted time frame, the Buyer will supply the Seller with a written report from a qualified veterinarian, and a second opinion will be required.
If both veterinarians are in agreement, then the puppy may be returned to the Seller, at the expense of the Buyer, and the Seller will replace the puppy with one of equal quality when one becomes available (not necessarily from same sire &/or dam). If the Buyer should decide to keep the puppy, he will be refunded 50% of the original purchase price.

Puppies purchased with the intention of showing/breeding will meet requirements of the Show-Breeding Addendum.

By signature below, both parties affirm that they have read, understand and are in agreement with all issues addressed in this purchase and sale agreement.
