These terms and conditions are entered into and agreed upon by both the Purchaser and the Breeder and they acknowledge the moral and legal worth of this contract. Therefore, it is agreed as follows:
1. Seller hereby transfers all right, title, and interest in one (1) male / female Labrador puppy from a litter whelped on 3/15/11 litter registration number TS02518104, for a purchase price of $2000, and $400 is hereby acknowledged as previously received as a deposit.
2. The selection of the puppy shall be by the mutual consent and agreement of the Breeder and Purchaser operating in good faith. In the event of a disagreement, the final choice shall be that of the Breeder.
3. Breeder hereby agrees to furnish Purchaser with AKC registration papers providing for limited registration at the time of sale. Breeder further agrees to furnish the Purchaser with a pedigree of the puppy.
4. Heybern Labradors recognizes that the decision to introduce a new puppy into your home is an important step for you and your family. While the benefits of pet ownership are many, these are balanced by new responsibilities that must be assumed by each family member. We recognize that, even after careful consideration, unforeseen circumstances may arise that prevent you from fulfilling these obligations. In consideration of concern for both you and the puppy, if for any reason you find the puppy to be unsuitable to your situation, you may return the puppy to Heybern Labradors within three days of purchase for a refund.
5. To the best of the Breeder’s knowledge, this puppy is in good health. However, Purchaser hereby agrees, at Purchaser’s expense, to have the subject puppy examined by a veterinarian of the Purchaser’s choice within fourteen (14) business days of receipt of said puppy. If, in the opinion of your veterinarian, your puppy has any physical problem which makes it a poor health risk, be suffering from a serious health defect or disease, be ill or otherwise in poor health, the Purchaser may return the puppy for a full refund of the purchase price. In order to make a claim under this provision, return the puppy to Heybern Labradors within three (3) days of the veterinarian’s examination. In addition, we require a signed statement from the veterinarian showing the date, within the fourteen day period, on which he conducted his examination and the reason why he believes the puppy to be a poor health risk. This statement must include a description of the symptoms supporting his opinion. In addition, after the fourteen (14) day period, but up to the puppy’s first birthday, should the puppy be found to be suffering from a physical problem, as noted above, Breeder will return one-half of the purchase price of the puppy if that puppy is returned to her. All of the requirements as stated above in regard to the veterinarian’s statement are also applicable to this provision, with the further requirement that the puppy’s health and vaccination records must be included.
6. This puppy must be licensed and cared for in accordance with local laws. Purchaser agrees to spay or neuter this puppy at the earliest time that the Purchaser’s veterinarian recommends.
7. Purchaser agrees to love and care for this puppy. Purchaser agrees to provide the puppy with annual veterinary checkups including heartworm check, to keep all immunizations current according to AVMA guidelines, to properly administer all medications, including heartworm preventative, to provide clean and adequate housing and to provide adequate nutrition. Purchase agrees to keep the puppy under leash control and/or yard training and to not permit the puppy to run free, without supervision.
8. If at any time and for any reason the Purchaser is unable or unwilling to keep this dog, it is agreed that it will be returned to the Breeder exclusively. If the Purchaser disposes of the dog in any other way without prior written consent of the Breeder, the Purchaser agrees to pay the Breeder $5000 in punitive damages on demand of the Breeder. The purpose of this clause is to offer the dog the maximum protection for a quality life, free from fear, abuse or neglect. If the dog is found by the Breeder to be mistreated or neglected, the Breeder reserves the right to repossess the dog.
9. This contract will be interpreted pursuant to the laws of the State of New York and jurisdiction and venue to resolve any dispute shall be within the County of Saratoga.
