(1) BUYER and SELLER agree that BUYER is aware that PORTUGUESE WATER DOG is being sold in good faith on a “limited registration” spay/neuter contract and shall be spayed or neutered between six (6) and nine (9) months of age.
(2) BUYER and SELLER agree that SELLER has no reasonable awareness of any physical illness of PORTUGUESE WATER DOG at the time of sale. BUYER is free to have PORTUGUESE WATER DOG examined by a licensed veterinarian within 72 hours of purchase time and date with the privilege of returning the dog to SELLER within that time if said veterinarian certifies that PORTUGUESE WATER DOG is not physically sound. BUYER understands that BUYER is responsible for any expenses incurred while returning PORTUGUESE WATER DOG to SELLER.
(3) BUYER and SELLER agree that they are not aware of any proven genetic illness that PORTUGUESE WATER DOG has. BUYER and SELLER agree that, if in the event that any proven genetic illness causing PORTUGUESE WATER DOG’s death before PORTUGUESE WATER DOG has attained six years of age, SELLER shall provide another PORTUGUESE WATER DOG to BUYER upon completion of SELLER’s next available litter.
(4) In the event that PORTUGUESE WATER DOG acquires severe hip dysplasia requiring hip replacement surgery before PORTUGUESE WATER DOG has attained six years of age, BUYER and SELLER agree that SELLER shall replace PORTUGUESE WATER DOG with another PORTUGUESE WATER DOG to BUYER upon completion of SELLER’s next available litter.
(5) BUYER agrees with SELLER that BUYER shall use the name “TIMBER OAKS” as a prefix to the name of PORTUGUESE WATER DOG when registering PORTUGUESE WATER DOG with the American Kennel Club or the Canadian Kennel Club.
(6) If for any reason, BUYER is unable or unwilling to care for PORTUGUESE WATER DOG, BUYER shall return PORTUGUESE WATER DOG to SELLER. Any monetary refund shall be disbursed at the sole discretion of SELLER.
(7) BUYER agrees to not place PORTUGUESE WATER DOG in any animal shelter, humane society, laboratory or research facility.
(8) PORTUGUESE WATER DOG shall not be chained by BUYER. BUYER agrees that PORTUGUESE WATER DOG shall be kept in some type of humane restraint of at least four feet by ten feet or larger in dimensions in a fenced kennel run.
(9) BUYER assumes all costs of shipping PORTUGUESE WATER DOG from or to SELLER, all costs of vaccinations, veterinary costs, insurance, liability to the public, etcetera as of the date of ____________________ and furthermore holds SELLER harmless therefrom.
(10) BUYER may not assign or transfer this agreement or any rights granted hereunder. This agreement binds and inures to the benefit of SELLER, BUYER, BUYER’s principals, employees, agents and affiliates are jointly and severally liable for the performance of all payments and other obligations hereunder. No amendment of waiver of any terms is binding unless set forth in writing and signed by BUYER and SELLER. However the contract may reflect, and BUYER is bound by, any oral authorizations for fees or expenses which could not be confirmed because of insufficient time.
(11) this agreement conforms with the laws of the United States of America and the laws of the state of Michigan. Any dispute regarding this agreement shall be adjudicated in the 86th District Court in the county of Leelanau, Michigan, or the 13th Circuit Court in the County of Leelanau, Michigan.
