Section Two: Seller/Breeder Obligations
This puppy is a purebred Shiba Inu, with the American Kennel Club registration pending and available at no additional charge to the buyer. _______________________________________ (Buyer) is completely satisfied and waives any and all claims regarding the puppy's conformation and outward appearance. Upon execution of this contract, ________________ _____________________ (Seller/Breeder) does hereby convey title and interest in the described Shiba Inu puppy to the buyer (except for the terms listed herein).
Ownership of the puppy shall be transferred to the Buyer for the sale price of $ ________, to be paid in full on or before execution of this contract. Only after the full amount is paid may the puppy be removed from the Seller/Breeder premises. All fees associated with the transportation of this animal from the Seller/Breeder’s premises are the responsibility of the buyer. This includes, but is not limited to, actual shipping charges, the cost of a shipping crate, and the required health certificates.
This puppy is sold with a limited AKC registration and must be neutered by the age of 8 months. Limited registration means that this dog may never be bred, and participation in some AKC events is restricted.
The Seller/Breeder warrants that the identified puppy is in good health and free of communicable diseases at the time Buyer assumes ownership. This puppy has been examined by a veterinarian prior to this sale and found to be in good health, but it is the purchaser’s responsibility to take the animal for a complete physical examination by his/her own veterinarian within 72 hours of taking possession. If within 72 hours of purchase, the animal is found to be ill or in poor health, a report of the findings is to be sent to Nekatzuki Shiba Inus. The animal can be returned immediately at no expense to the Seller/Breeder, for replacement, pending verification by the Seller/Breeder's veterinarian. Nekatzuki Shiba Inus will not be responsible for illness or health problems that are diagnosed after this time period except those conditions specified below.
Although there is no guarantee that a puppy will not have problems with knees, hips or elbows, we are making every effort to avoid such an occurrence through scrupulous screening by the Orthopedic Foundation for Animals (OFA). We will replace this puppy at any time in its life if crippling hip dysplasia, elbow dysplasia or luxating patellas is properly diagnosed. (Properly diagnosed means that one or more x-rays have been taken and evaluated by a licensed doctor of veterinary medicine.) The Seller/Breeder’s veterinarian must confirm diagnosis. If a replacement is to be made, the dog shall be returned to the Seller/Breeder and registration signed over to the Seller/Breeder at that time. Nekatzuki Shiba Inus will not be responsible for any veterinary or other expenses incurred, nor will the Seller/Breeder pay for any transportation charges for the replacement puppy. Under certain circumstances, the Seller/Breeder may elect to allow the buyer to keep the affected puppy. If the buyer requests to keep the puppy, a certification of sterilization must be given before any replacement is made. In the event that the puppy being replaced has either conceived (in the case of a bitch puppy) or sired (in the case of a male puppy) a litter, this guarantee becomes null and void.
The Shiba Inu must be fit in body and mind to be a suitable companion to his owners. Poor temperament can stem from a variety of reasons, from genetic fault to environment and poor early socialization. Faults of temperament that cannot be repaired by qualified professionals are considered to be a result of hereditary influences and permanent. If the following type of bad temperament is deemed to be uncorrectable by a licensed animal behavior professional, the puppy may be returned to its Seller/Breeder and the registration signed over to the Seller/Breeder.

Puppies returned for proven hereditary temperament faults may be euthanized. After the AKC registration is signed over to the Seller/Breeder, a replacement shall be made.
Section Three: Buyer Obligations
The buyer swears that he/she is not acting as an agent in the purchase of this animal and that it will remain solely in his/her custody. Buyer further swears that he/she is not associated with a pet shop or animal broker, and will not sell this puppy or any of its progeny to any agent, pet store, puppy brokering business or guard dog business.
The Buyer agrees to maintain the optimum health care of the puppy by providing, but not limited to: annual vaccinations or titer testing, internal as well as external parasite control, and heartworm prevention medication.
The buyer agrees that ownership and/or possession of this dog will not be transferred. Should it become necessary to re-home this puppy, he will be returned to the Seller/Breeder, at no cost to the Seller/Breeder, and ownership transferred directly to the Seller/Breeder. The Seller/Breeder will accept the return of this dog at any time the purchaser declines to keep said dog, and AKC registration shall be signed over to the Seller/Breeder. The Seller/Breeder is not obligated to refund any portion of the purchase price except as stated in conditions specifically stated in this contract.
The Buyer agrees to maintain the integrity of the puppy’s joints and bone structure by providing, but not limited to, the following:
A well-balanced and nutritious diet
Satisfactory sleeping arrangements (not outdoors or on cement or concrete)
Proper exercise (no forced exercise such as running, until at least 12 months of age.)
Preventing stress injuries (i.e. not allowing the puppy to jump from heights taller than its shoulder height)
All expenses regarding this animals including but not limited to: shipping of the animals, proper care, veterinary fees, housing, reversal of limited registration, or legal liabilities are the sole responsibility of the buyer.
The buyer agrees to inform Nekatzuki Shiba Inus of any titles or awards obtained by the animal for our breeding records. The buyer will inform the Seller/Breeder of any change in address or phone number so that we may keep track of all animals bred by this kennel. The animal will retain the Nekatzuki kennel name.
The Buyer agrees that the Seller/Breeder may repossess the animal upon evidence of neglect and/or abuse at no expense to the Seller/Breeder, without refund of any monies.
Violation of the terms of this contract renders all guarantees stipulated in this contract to be null and void and may result in the buyer being required to return the dog to the Seller/Breeder within five days of receipt of notice from the Seller/Breeder. The buyer will be responsible for the cost of the dog's transport back to the Seller/Breeder. If the buyer violates this agreement, he or she will be responsible for any/all legal costs the Seller/Breeder incurs enforcing this contract.
This Agreement is made and signed by both parties to insure the well-being and protection of this animal. If any part of this agreement is breached, the Seller/Breeder is released from any further obligations hereunder.
