General Terms and Provisions:
Buyer agrees to these General Terms and Provisions;
1. This agreement is made and signed by both parties to insure the well being and protection of this animal. If any part of this agreement is breached by Buyer, Seller is released from any further obligation hereunder.
2. Only after the full purchase price is paid, may the puppy be removed from Seller’s premises. If the balance due after initial deposit is left unpaid as of _____, 2009, this agreement shall be canceled at Seller’s option and Buyer shall forfeit any previously paid amount hereunder unless otherwise agreed upon. Any changes to this time line that have been mutually agreed upon shall be made in writing, signed and dated by both parties and attached to this original document.
3. Buyer agrees that any and all transportation costs, to and/or from the Seller’s premises, will be at the cost and sole responsibility of Buyer.
4. Buyer agrees to maintain preventative health care of the puppy
5. Buyer agrees to maintain preventative care of the puppy in regards to hip and elbow dysplasia, and patella injury such as proper nutrition, proper exercise, and preventing stress injuries.
6. Buyer agrees that this animal will not be used for breeding purposes until they have met the following criteria (and the proposed breeding dog as well) either registered with the AKC or other certified dog registry (ADRK, USRC) and only after it has obtained the following proof thereof:
a. OFA or OVC certifications for clear hips and elbows at minimum.
b. Current negative Brucellosis report from Veterinarian
c. All inoculations and worming up to date.
7. Said puppy must be examined by an OFA or OVC approved veterinarian and certified clear by OFA or OVC via x-rays for hips and elbows. Buyer has 10 days from receipt of OFA report to submit copies of said reports to Seller by certified mail. All associated costs of testing, certifying, documenting, copying and mailing required documents are the sole responsibility of Buyer.
8. Should Buyer breed the animal before ALL of the requirements listed in this section are met, the Buyer acknowledges the Seller’s right to execute Seller’s right to repossess the animal that is the subject of this contract, as well as any and all offspring derived from the breeding in question. There will be NO refund of any monies paid to Seller, and it will be left to the Seller’s discretion as to the placement of the animal and any of its offspring.
9. If at any time prior to 24 months of age, Buyer chooses not to breed a show prospect dog, Buyer shall supply proof of surgical sterilization. Buyer has 10 days from date of surgery to provide proof of surgery to Seller by certified mail.
10. Buyer agrees NOT to start Schutzhund Bite / Protection Training of this animal, until it has reached a minimum of 8 months of age. (Thus allowing the animal the physical as well as mental maturity level not to harm or damage the animal.) Buyer agrees that he/she is not acting as or in part of, an agent in the purchase of this puppy and that Buyer will not sell this puppy or any of it’s progeny to any agent, pet store, or guard dog business.
11. Buyer agrees that should it become necessary to place this puppy/dog, Buyer will notify Seller in writing by certified mail before taking such action. Buyer agrees to return dog to Seller at no cost to Seller. If Seller is not in a position to accept said dog back, Seller will assist Buyer in finding an appropriate home for said dog within a reasonable time period. Buyer is responsible for all shipping/relocating costs. Upon receipt of notification, Seller shall have 21 working days to exercise said option. Exercise shall be notice in writing (to include, but not limited to email) sent to Buyer.
12. Buyer agrees that the Seller may repossess the animal upon evidence of neglect and/or abuse or for “breach of contract” at no expense to Seller, and no refund of any monies, if this occurs, the deposit is forever forfeited.
13. Buyer agrees that the puppy will not be tied outside either supervised or unsupervised at any time for any length of time. Buyer agrees that the puppy/dog should be properly and safely contained within a fenced yard or kennel run with safe and appropriate access to housing whether indoors or out. If the dog is to be housed in a kennel situation, said kennel must be properly protected from the elements and be enclosed by a secure fence and locked gate. Buyer agrees that said dog shall never be permitted to run free at any time unless under the control of a certified training instructor.
14. Buyer agrees that the puppy will reside at the home of Buyer and not housed at another location. This animal is sold with the understanding that it was to go to select homes, be socialized properly, and become a member of the family.
15. Buyer agrees to socialize said dog properly with adults, children, and elderly people. Buyer agrees that said dog shall not be left unattended with children or infirm people and that all play involving children be closely supervised. Buyer agrees that said dog will always be kept under their control and that Buyer will never allow anyone who doesn’t have the ability to keep said dog under control to walk or otherwise interact alone with the dog.
16. Buyer agrees to at minimum, take this dog through intermediate level obedience training by the age of 18 months. A copy of training attendance certificate, graduation certificate or other proof documenting the dog’s training class attendance should be sent to Seller via certified mail no more than 10 days from completion of each class level.
17. Buyer understand that in order to fulfill the puppy’s full potential, she must be conscientiously campaigned by and at the sole expense of the Buyer in the AKC, ARV, ADRK, FCI, IFR, AKC, CKC, and/or USRC show circuits and working venues. Seller makes no guarantee expressed or implied as to said dog’s ability to win classes of place highly in any given show or working venue on any given day. Furthermore, Buyer acknowledges that the ability for the said dog to excel at expected levels in the aforementioned working venues requires responsible and consistent training by Buyer and a qualified training instructor and/or training director. Seller makes no guarantee expressed or implied as to said dog’s ability to place highly in any given working venue on any given day.
18. Buyer agrees to provide updated address, telephone number and any other contact information to Seller within 14 days of any change of residence.
19. The Buyer agrees to leave the tail intact on said dog. The tail may ONLY be removed if warranted because of injury, and a copy of the veterinarian notes must be sent to the Seller within 10 business days. This is due to GMRotts following the F.C.I. standard.
Special Terms and Provisions
Buyer agrees to the following special terms and provisions;
1. Buyer agrees that an immediate $500 non-refundable cash deposit is due to Seller upon the signing of this contract as a show of good faith and serious interest in said dog. This deposit shall be deducted from the total purchase amount.
2. Buyer agrees that the sum of one thousand dollars USD ($1000 USD) cash or money order is payable to Seller by no later than midnight on _____, 2009 unless otherwise agreed to in writing and signed by both parties. Should Buyer fail to pay aforementioned sum to Seller within the described time period, Buyer agrees that this constitutes a breach of contract and forfeits any and all previously paid monies.
3. Buyer agrees that once they take possession of said dog they are 100% responsible for the health, well being and condition and any and all costs associated with owning said dog.
Refunds
There shall be no refund of purchase price for said puppy nor will a puppy of greater value be given as replacement. This guarantee must be presented as proof of amount of purchase and/or quality of puppy at any time a request is being made for replacement.
Entire Agreement. This contract contains the entire understanding and agreement between the parties signed below in regards to the purchase of said Rottweiler puppy. This contract cannot be modified, amended or otherwise changed other than by writing and signed by all parties involved. Upon receipt of contract signed by buyer, Seller shall sign and mail/deliver 1 copy of this contract to Buyer. I/We the Buyer, certify that I/We have read the foregoing contract; understand its contents and I/We hereby agree.
