We hope that you will enjoy your new puppy for many years to come. We have taken the necessary steps to ensure that your new pet arrives healthy. Your puppy will be offered with heath guarantee that is valid until your puppy is 24 months of age.

Terms of Agreement
1. Seller states that the puppy is guaranteed healthy at the time of purchase, will be examined by a licensed veterinarian, has been checked for intestinal parasites, and has been de-wormed in accordance with the veterinarian's instructions. Seller further states that the puppy will have had first puppy shots at 6, 9, 12, and 15 weeks of age, if the pup is still in his/her possession at that time. Seller agrees that this puppy has been kept isolated from outside animals and has not been exposed to any infectious disease to the best of his or her knowledge.
2. A $250 non-refundable deposit is required to hold a puppy. Puppies must be picked up by 8 weeks of age, unless special circumstances warranting a longer stay are agreed upon. The deposit is non-refundable, unless the contract is voided by the Seller.
3. This puppy is purebred, and is registerable with the American Kennel Club. The bill of sale and the proper papers for registration will be presented to Buyer(s) when puppy is paid for in full and delivered.
4. Buyer agrees to have this puppy health checked by a licensed veterinarian within 72 hours of receiving the puppy and a written copy of the health check (signed by the veterinarian) mailed to Seller within 10 days of purchase. If the puppy is not seen by a veterinarian and the necessary papers are not sent to the buyer in the time stated, the health guarantee is void. Should the veterinarian find that this pup has a serious disease or genetic defect and a written statement is provided by the examining veterinarian, then the puppy will be replaced or a refund of the purchase price of the puppy will be given. The puppy must be returned to the seller before the purchase price is refunded. The Seller will not be liable for any shipping costs to return the puppy to the seller for any reason. If the pup would die before then, an autopsy must be performed at the buyer’s expense, to indicate that the pup did die of a genetic defect.
5. This guarantee covers your puppy until 24 months of age against fatal and life altering congenital and genetic diseases which adversely affect the health of the animal. This includes: hip dysplasia, elbow dysplasia, severe luxating patellas, generalized (not localized) demodectic mange, kidney and heart failure, spine and liver problems of a severe life threatening or altering nature. The Seller agrees that in the event that genetic life-impairing defect is diagnosed by (2) veterinarians within the first 24 months of a puppy's life, said animal will be given another of equal value, when available, or will be reimbursed for the cost of the puppy (not including shipping costs) if a litter is not expected within a calendar year. If the buyer wishes to have a dog of higher value than the purchase price, the buyer will be responsible for the difference. Copies of all verifying tests made to diagnose must also be presented to Seller and be reviewed by Seller's veterinarian. The report must be clear and precise stating the symptoms, exact problem, severity, and diagnostics performed, i.e. x-ray, ultrasound, bloodwork. Buyer must relinquish the puppy/dog to the breeder, unless proper arrangements are made to provide proper veterinary care for the condition. If the buyer returns the dog to the Seller, then the Buyer will assume all shipping costs to do so. This guarantee is only valid if the puppy is owned by the original owner.
6. Under no circumstances do we guarantee any preventable or accidental death, injury or illness. Examples: Failure to vaccinate on schedule, vaccination reactions, treatment against heartworm or any other parasites, or failure to seek veterinarian treatment as needed. We also do not guarantee puppy from illness or death caused by any cosmetic surgery, gastric torsion nor any illness believed to be related to overfeeding high amounts of proteins, vitamins or minerals. The purchaser will not allow the puppy/dog to run or exercise for at least ½ hour before and 1 1/2 – 2 hours after meals, in order to prevent gastric torsion or bloat. This guarantee also does not cover cherry eye, localized demodectic mange, bladder stones, entropion, or ectropion.
7. There is no guarantee that the purchaser will be able to show or breed the puppy regardless of showing or breeding potential. We can only offer our professional opinion.
8. Seller will not be responsible for veterinary fees or costs. The purchaser is aware that owning a puppy means trips to the veterinarian and understands that he or she will be responsible for all payments. Veterinary care including vaccines, de-worming, heartworm prevention, and regular check ups are all a part of owning a puppy. This guarantee will not cover neglect or improper care by the purchaser. This health guarantee is valid only if puppy is current on all vaccinations and heartworm prevention. Guarantee becomes void if Seller's Veterinarian determines that the illness or death of the puppy was due to neglect, abuse, or natural causes in any way.
9. If said puppy is found to be abused or neglected it will be turned over to the seller, with no refund issued, and at the cost of the Seller.
10. In the event the Buyer finds that they are unable to keep this puppy/dog for any reason, Buyer agrees to return the
puppy at the Buyers expense to the Seller in order that Seller may find a suitable home for the puppy/dog. This will insure that the puppy/dog will always be wanted and not end up in a shelter.
11. Buyer agrees to keep puppy isolated from other animals until series of shots is completed in order to avoid contagious diseases. Buyer agrees that this puppy has no known health problems.
12. Seller guarantees that socialization has been done in accordance with the age of the puppy, that he/she has been introduced to adults, children, and other animals.
13. Buyer agrees to provide space in a safe and proper area that is adequate for the breed. Buyer agrees that this is to be an INDOOR dog. Buyer agrees that the puppy is to be protected from extreme cold or heat and dangerous encounters that may jeopardize the welfare of the puppy/dog. The Buyer understands and agrees that the puppy needs all of the appropriate inoculations at intervals suggested by Buyer's veterinarian. The puppy should be placed on heartworm preventive as well as flea prevention monthly. Buyer agrees to keep his or her dane on a high quality food, with no more that 24% protein and 12% fat.
14. Conditions of Limited Registration: If limited registration is set forth, Buyer agrees to have his or her puppy
spayed or neutered by a veterinarian by six months of age or at an age deemed appropriate by their veterinarian. A copy of the receipt from this procedure may be requested by the Seller. At this time, the Seller agrees to send the AKC papers to the Buyer.
15. Conditions of Full Registration: If full registration is granted, the Buyer agrees to wait until the puppy is 24
months old if a female, or 12 months old if a male, before breeding. Buyer also agrees to have appropriate health testing performed before breeding. If the dog is bred before the ages set forth, the health guarantee is null and void.
I, the Buyer, have read and understand the terms of this guarantee/agreement. I also understand that if I do not uphold my part of this agreement, the breeder has the right to take the puppy back at no compensation to me. It is further understood and agreed that no warranty or representation has been made with respect to sold puppy/dog except as set forth in this document.
This contract contains the entire agreement of the parties and shall be construed and enforced in accordance with the laws of the State of West Virginia. Both parties stipulate that there are no other agreements other than those set forth in this document. Any legal action filed by either party in an effort to enforce the terms of this contract will be filed Hampshire County West Virginia. If any legal action occurs, the prevailing party will be entitled to recover reasonable costs and attorney’s fees. Each party acknowledges that they have read and understand the terms and conditions of the Health guarantee and have voluntarily entered into and executed this agreement.
