OREILLE "SAMPLE" SHOW PROSPECT CONTRACT
Congratulations !! You are now the proud owner of an Oreille dog. OREILLE KENNELS believes that you aim to find a happy, healthy, beautiful dog and for that you should be entitled to one. This is a contract to inform you of your rights and explain to you all the benefits and conditions of owning (or co-owning) an OREILLE dog. This contract is enforceable.
On this ___ day of ________, 200__, Helayne Parker of OREILLE KENNELS, sells to _________ a _________ & White male/female Pointer AKC# ________________ , whelped on __________________. For the sum total of $ ______. The dog was sired by Champion ____________________ (OFA). The dog's dam is Champion __________________(OFA). Helayne Parker of OREILLE KENNELS (hereinafter referred to as "seller") agrees to sell, and _______________ (hereinafter referred to as "buyer") agrees to purchase the above mentioned dog (hereinafter referred to as "dog"). Payment for the dog will be as above. All fees, arrangements and payments for shipment of the said dog will be the buyer’s responsibility in total.
The dog the buyer has purchased was deemed show quality via evaluation at 8 weeks of age. Upon obtaining the new dog the buyer will have 72 hours to have the dog examined by a licensed veterinarian to be assured the dog is in the state of health agreed to by both parties upon transfer. The seller guarantees that the dog has had all the required medical care up to date (shots, worming, etc.). The puppy also has had a 'well puppy check-up" before placing. A medical record has been handed over with the dog. The seller also guarantees the dog against any genetic defects up to the dogs 5th year old birthday (ending ___________). If at any time during the covered period the dog is declared mentally or physically unsound by a licensed veterinarian, the seller will, upon return of the dog, replace the dog with one of "equal quality and value", when one becomes available. If the unsound dog is retained by the buyer the dog must be altered and a copy of the certification of alteration is to be presented to the seller. In this case the dog will also be replaced. If a dog is returned for replacement any and all fees (i.e. shipping, crates etc.) is the buyer’s responsibility in full. If the buyer decides within a 7 day period not to keep the dog a 100% cash refund in the amount noted on this contract (minus the non-refundable deposit) as purchase price will be granted after return of the said dog.
OTHER CONDITIONS:
The seller WILL/WILL NOT co-own the above mentioned dog with the buyer.
In the cases of co-ownership, the breeding of a co-owned dog must be agreed to by the seller. The stud dog used (or bitches that Oreille male dogs are to be used on) must compliment the OREILLE dog's pedigree, physical structure and be on mutual agreement of the buyer and seller.
Any co-owned Pointer that is to be bred must be-
1) At least two years of age
2) Orthopedic Foundation for Animals OFA clear of hip dysplasia. Elbows must also be done. PennHip also accepted.
3) Ideally will be CERFed before breeding.
4) Brucellosis Tested
5) Have a correct scissors or level bite
6) And be of good health and temperament, and physically capable of producing puppies.
If any co-owned OREILLE dog does not test clear for the above noted health screens he/she should be spayed or castrated immediately unless a re-evaluation is recommended. If all is passed and the dog is to be bred the partner dog should also be genetically screened with preferably the same tests and clear. If not at least OFA clear for hips on Pointers. If co-owned animal is a bitch, documentation must be available for OREILLE to view before any litter papers are signed off.
Protect your breed if you love it do not purposely breed dogs w/ genetic defects or problems this includes bad bites.
NOTE:
**All intact Pointers whether co-owned or NOT must be radiographed for detection of hip dysplasia between the ages of 24 and 36 mos (30 to 36 mos ideal). Radiographs shall be submitted to either the OFA or PennHip for evaluation and/or scoring. A xerox copy of a passing certificate will be sent to Oreille upon your receipt for our kennel records. Any dog that does not pass should be spayed or castrated and will be replaced.
In the cases in which seller co-owns a bitch of breeding/show quality with the buyer, the seller is entitled to one puppy back (of the seller's choice) from that co-owned bitch's first litter. Oreille will own that puppy "outright" and the Oreille prefix will be contained at the front of that puppy's name. In cases where the buyer(s) co-own a male dog with the seller-stud availability to the above mentioned dog will be allowed to the seller at no cost.
In the event the buyer can not properly take care of or is not satisfied with the dog, the seller will get "first offer" to take the above mentioned dog back, regardless of age. Never at anytime will the seller be asked to pay for the dog. The seller will make every effort to sell the dog for the buyer and refund the buyer (if a replacement is not chosen) the funds that were received minus any expenses taken on by the seller. If the seller can not take the dog back, or find a home for him/her, a home may be chosen by the buyer; however, it must be approved by the seller. If the dog is ever to be "returned" to the seller because they no longer want him/her or can not keep him/her ALL shipping expenses will be paid for by the party listed as "buyers" noted on this contract.
The dog will always be kept in good condition (bathed, groomed, teeth clean, nails trimmed etc). kept on heartworm preventative as necessary for the buyer's geographical area, vaccines and worming kept up to date, veterinarian checked regularly, and just all and all be well cared for and conditioned.
The buyer hereby also acknowledges that the Pointer is a dog that requires a fenced-in yard and loving care. The buyer agrees to be a responsible dog owner, who neither allows his/her dog to run loose or allows it to be bred indiscriminately. The buyer understands that the dog must be properly socialized and that the seller strongly advises an obedience class or conformation show handling class as part of this socialization.
A Champion is not guaranteed if the buyer has purchased a show prospect; however, show handling and training are recommended. It is agreed that the buyer of a show prospect will make every effort to obtain an AKC Championship title on the above-mentioned dog. It is HIGHLY recommended to finish a dog to it's championship before breeding. If the dog is to be kept as a pet, and not shown it should be altered. It is HIGHLY recommended to finish a dog to it's championship before breeding. We DO NOT encourage the breeding of non-champions.
If the buyer intends on using an OREILLE dog in the field the dog has been on gunshot sounds since the age of __N/A__. Care must be taken to maintain the coat and skin of your show prospect.
